أصدرت دار الإفتاء ببانجسامورو فتوى بشأن استخدام بطاقة ائتمان الغير مقابل زيادة مؤجلة

أصدرت دار الإفتاء ببانجسامورو فتوى بشأن استخدام بطاقة الائتمان الخاصة بشخص آخر مقابل دفع مبلغ إضافي مؤجل. وبحسب دراستهم، فإن هذا النوع من الاتفاق لا يُعد بيعًا صحيحًا، بل هو في حقيقته قرض، حيث يقوم صاحب البطاقة بالدفع نيابةً عن غيره، ثم يُطالبه بالسداد في وقت لاحق مع زيادة وتُعد هذه الزيادة منفعةً ناتجة عن القرض، وهي من الربا المحرّم في الشريعة الإسلامية.

كما أوضحت الفتوى أن هذا النوع من المعاملات غير جائز لاحتوائه على عنصر ربا النسيئة (الزيادة بسبب التأجيل)، ولعدم استيفائه شروط البيع الصحيح.

ومع ذلك، توجد بدائل مشروعة مثل المرابحة للآمر بالشراء (البيع بالتقسيط مع بيان السعر بوضوح) والوكالة (التفويض أو التمثيل) بشرط خلوّها من أي فائدة ربوية. ومن خلال ذلك، تُشجّع دار الإفتاء المجتمع على الالتزام بالمعاملات المتوافقة مع أحكام الشريعة، حفاظًا على العدالة وتجنبًا للوقوع في المحرّمات.

Ang Bangsamoro Darul-Ifta' ay naglabas ng Fatwa hinggil sa paggamit ng credit card ng ibang tao kapalit ng ipinagpalibang dagdag na bayad. Ayon sa kanilang pag-aaral, ang ganitong kasunduan ay hindi isang wastong bentahan kundi isang uri ng pautang, kung saan ang may-ari ng card ang nagbabayad para sa iba at sinisingil ito sa hinaharap na may karagdagang halaga. Ang nasabing dagdag ay itinuturing na pakinabang mula sa pautang na kabilang sa ipinagbabawal na riba sa ilalim ng batas ng Shari’ah.

Ipinaliwanag din sa Fatwa na ang ganitong transaksyon ay hindi pinahihintulutan dahil ito ay may elementong riba al-nasī’ah (interes dahil sa pagpapaliban) at hindi natutugunan ang mga kondisyon ng isang wastong bentahan. Gayunpaman, may mga pinahihintulutang alternatibo tulad ng murabaha (hulugang bentahan na may malinaw na presyo) at wakala (ahensiya o pagiging tagapamagitan) na walang kasamang interes. Alhamdulillah. On April 26, the 𝙎𝙤𝙘𝙞𝙚𝙩𝙮 𝙤𝙛 𝙄𝙨𝙡𝙖𝙢𝙞𝙘 𝘽𝙖𝙣𝙠𝙞𝙣𝙜 𝙖𝙣𝙙 𝙁𝙞𝙣𝙖𝙣𝙘𝙚 𝙎𝙩𝙪𝙙𝙚𝙣𝙩𝙨 (𝙎𝙄𝘽𝙁𝙎) gathered a powerhouse of experts at the Al Farouqi Assembly Hall (KFCIAAS) to tackle the theme: “𝐈𝐬𝐥𝐚𝐦𝐢𝐜 𝐁𝐚𝐧𝐤𝐢𝐧𝐠 𝐚𝐧𝐝 𝐅𝐢𝐧𝐚𝐧𝐜𝐞: 𝐁𝐞𝐭𝐰𝐞𝐞𝐧 𝐈𝐝𝐞𝐚𝐥𝐬, 𝐈𝐧𝐬𝐭𝐢𝐭𝐮𝐭𝐢𝐨𝐧𝐬, 𝐚𝐧𝐝 𝐏𝐫𝐚𝐜𝐭𝐢𝐜𝐞𝐬.”

​𝘒𝘦𝘺 𝘛𝘢𝘬𝘦𝘢𝘸𝘢𝘺𝘴 𝘧𝘳𝘰𝘮 𝘰𝘶𝘳 𝘚𝘱𝘦𝘢𝘬𝘦𝘳𝘴:

​Bridging Innovation & Tradition: 𝗦𝗵𝗲𝗶𝗸𝗵 𝗠𝗼𝗵𝗮𝗺𝗺𝗮𝗱 𝗙𝗮𝗿𝗼𝗸 𝗦𝗮𝗮𝗱𝗼𝗱𝗶𝗻 explored the intersection of Islamic finance and the technological revolution. He highlighted the potential of blockchain to boost transparency but reminded us that tools like cryptocurrency must undergo rigorous Shariah evaluation. Efficiency is great, but compliance is non-negotiable.

​The Blueprint for Ethical Business: 𝗦𝗵𝗲𝗶𝗸𝗵 𝗛𝗶𝘀𝗵𝗮𝗺 𝗣. 𝗠𝗮𝘀𝗮𝗰𝗮𝗹 broke down the pillars of Islamic Commercial Law. While transactions are generally permissible, he reminded us of the "red lines": avoiding harm (darar), injustice (zulm), riba, and excessive uncertainty (gharar). True wealth is defined by what is lawfully owned and ethically utilized.

​A Call for Integrity: Guest participant Dr. Leonilo Go Paulin Jr. capped off the day with deep insights from his career as a Shari’a lawyer and halal advocate. He challenged the next generation of practitioners to lead with justice and integrity as the financial landscape continues to shift.
