P R E L I M I N A R Y INVESTIGATION
Custodial investigations means any questioning initiated by law enforcement officers after a person has been taken into custody or otherwise deprived of his freedom of action in any significant way. On the other hand, preliminary investigation has been defined as an inquiry or a proceeding the purpose of which is to determine whether there is sufficient ground to engender a well-founded belief a crime has been committed and that the respondent is probably guilty thereof and should be held for trial.
Custodial investigation begins when there is no longer a general inquiry into an unsolved crime and the investigation has started to focus on a particular person as a suspect. Whereas preliminary investigations begins when the prosecutor determines whether there is a probable cause that a crime has been committed. It has been explained that preliminary investigation is an executive function that the courts cannot interfere with in the absence of grave abuse of discretion.
