𝗜𝗗𝗜𝗡𝗔𝗢𝗦 𝗔𝗡𝗚 𝗞𝗔𝗨𝗡𝗔-𝗨𝗡𝗔𝗛𝗔𝗡𝗚 𝗕𝗔𝗥𝗔𝗡𝗚𝗔𝗬 𝗘𝗟𝗘𝗖𝗧𝗜𝗢𝗡 𝗦𝗔 𝗣𝗜𝗟𝗜𝗣𝗜𝗡𝗔𝗦

Noong May 17, 1982, idinaos ang kauna-unahang barangay election sa Pilipinas.

Sa bisa ng Batas Pambansa Blg. 222 na nilagdaan ni Pangulong Ferdinand Marcos, noong March 25, 1982, idinaos ang pambansang halalan para sa pitong opisyales ng barangay noong May 17, 1982. Ito ang kauna-unahang barangay elections na ginanap sa Pilipinas. Isang kapitan at anim na kagawad, na marapat ay (1) Filipino; (2) residente ng naturang barangay nang 'di bababa sa anim na buwan bago ang halalan; (3) rehistradong botante ng barangay; (4) nakababasa at nakasusulat; at (5) hindi bababa sa 21 taong gulang sa araw ng halalan, ang inihalal ng mga botante. Itinakda ang May 1, 1982 para sa paghahain ng kandidatura habang nagsimula naman ng May 1 hanggang 15 ang panahon ng kampanya. Layunin ng barangay election na bigyan ng autonomiya ang mga barangay upang mapaunlad ang kanilang mga komunidad.

Bago ang 1982, idinadaos ang halalan para sa mga barangay official kasabay ng local elections. Ayon sa Republic Act No. 3590, idadaos ang barangay election sa ikalawang Linggo ng Enero, pagkatapos ng halalan para sa municipal at provincial officials. Sa ilalim ng Barangay Elections Act of 1982, itinakda sa anim na taon ang termino ng mga barangay official. Itinakda rin sa June 7, 1982 na simula ng kanilang termino. Karamihan sa mga nahalal noong 1982 barangay elections ang hindi natapos ang kanilang termino dahil sa pagpasok ng administrasyong Cory Aquino noong 1986. Pagkatapos ng 1986 People Power Revolution, nagtalaga ng mga officers-in-charge ang bagong administrasyon sa mga barangay.

Ang sunod sanang barangay election na idadaos ng May 1988 ay naudlot at naurong ng March 1989. Noong 1998, pinababa sa limang (5) taon ang termino ng mga barangay official, alinsunod sa Republic Act No. 8524. Pinababa pa ito sa tatlong (3) taon noong 2002 sa bisa ng Republic Act No. 9164.

That's not just frustrating — in many cases, 𝘵𝘩𝘢𝘵'𝘴 𝘪𝘭𝘭𝘦𝘨𝘢𝘭.

⚖️ 𝗪𝗵𝗮𝘁 𝘁𝗵𝗲 𝗟𝗮𝘄 𝗦𝗮𝘆𝘀

Republic Act 11032 — the Ease of Doing Business and Efficient Government Service Delivery Act of 2018 — is very clear:

When the authorized signatory is on official business or official leave, 𝘢𝘯 𝘢𝘭𝘵𝘦𝘳𝘯𝘢𝘵𝘦 𝘮𝘶𝘴𝘵 𝘣𝘦 𝘥𝘦𝘴𝘪𝘨𝘯𝘢𝘵𝘦𝘥 as signatory. The absence of an officer is 𝘯𝘰𝘵 𝘢 𝘷𝘢𝘭𝘪𝘥 𝘦𝘹𝘤𝘶𝘴𝘦 for inaction or delay.

The law even allows electronic signatures and pre-signed documents to be used — so there is practically no more reason for these kinds of delays.

🚨 𝗪𝗵𝗮𝘁 𝗛𝗮𝗽𝗽𝗲𝗻𝘀 𝗧𝗼 𝗢𝗳𝗳𝗶𝗰𝗲𝗿𝘀 𝗪𝗵𝗼 𝗗𝗲𝗹𝗮𝘆

Penalties are in place. Under RA 11032:

→ 𝘍𝘪𝘳𝘴𝘵 𝘰𝘧𝘧𝘦𝘯𝘴𝘦: 6-month suspension
→ 𝘚𝘦𝘤𝘰𝘯𝘥 𝘰𝘧𝘧𝘦𝘯𝘴𝘦: Dismissal from service
→ If connected to corruption: Criminal charges

✅ 𝗪𝗵𝗮𝘁 𝗬𝗼𝘂 𝗖𝗮𝗻 𝗗𝗼

If you are stonewalled by an absent signatory:

1. Ask for the 𝘥𝘦𝘴𝘪𝘨𝘯𝘢𝘵𝘦𝘥 𝘢𝘭𝘵𝘦𝘳𝘯𝘢𝘵𝘦 𝘴𝘪𝘨𝘯𝘢𝘵𝘰𝘳𝘺 by name — this is required by law
2. Document everything: dates, names, what was said
3. File a complaint with the 𝗔𝗻𝘁𝗶-𝗥𝗲𝗱 𝗧𝗮𝗽𝗲 𝗔𝘂𝘁𝗵𝗼𝗿𝗶𝘁𝘆 (𝗔𝗥𝗧𝗔) at arta (.) gov (.) ph
4. You may also escalate to the 𝗖𝗶𝘃𝗶𝗹 𝗦𝗲𝗿𝘃𝗶𝗰𝗲 𝗖𝗼𝗺𝗺𝗶𝘀𝘀𝗶𝗼𝗻 (𝗖𝗦𝗖)
