‘PEOPLE’S INITIATIVE’ PARA BIGYAN NG PANIBAGONG PRANGKISA ANG ABS-CBN, IKINAKASA NA; MGA ABOGADO SA MAGKABILANG PANIG, NAGKARAMBOLA!
TANONG: Lalahok ka ba sa signature drive para magpatuloy ang operasyon ng ABS-CBN?

Usap-usapan ngayon ang posibilidad na pagbibigay ng animo’y mala-palos na prangkisa sa ABS-CBN sa pamamagitan ng People’s Initiative, matapos pormal na ibasura ng Kamara kahapon ang franchise application ng istasyon.

Pinangunahan ni University of Santo Tomas Faculty of Civil Law professor Atty. Enrique dela Cruz ang pagbubukas sa paksa tungkol sa Republic Act (RA) No. 6735 o ang ‘The Initiative and Referendum Act’, na mas kilala sa tawag na People’s Initiative Act, para sa pagbibigay ng prangkisa sa Kapamilya Network.
Giit ng propesor, hindi raw ito pwedeng pigilan kahit ng pangulo o Kongreso.
“The voice of the people is the supreme law. All government authority emanates from the people,” ani Dela Cruz.
Sinegundohan naman ang panukalang ito ni dating Presidential Management Staff Undersecretary Atty. Herminio Bagro III.
“Kung ayaw ng Kongreso, taumbayan na mag-renew ng prangkisa ng ABS-CBN via people’s initiative…kaya ba?” tanong ni Bagro, na ngayo’y nagsisilbing Chief of Staff ni Senador Kiko Pangilinan.
Nauna rito, nanawagan din kamakailan si San Beda Law Graduate School Dean Fr. Ranhilio Callagan-Aquino na idaan sa People’s Initiative ang prangkisa ng istasyon kung hindi ito ibibigay ng Kongreso.
Aniya, sisiw lang daw ito kung gusto talaga ng taong-bayan na magpasahimpapawid ang ABS-CBN.
Duda naman si Dating Senador Juan Ponce Enrile na kayang idaan sa People’s Initiative ang pagbibigay ng prangkisa sa laki ng kinakailangang pirma para rito.
Para kay Enrile, “wala na…the end of the road” na raw para sa media giant.
Sinopla naman ni DDS blogger at radio commentator Atty. Trixie Cruz-Angeles ang suhesiyong ito dahil hindi raw pasok sa kuwalipikasyon ng RA 6735 ang pagbibigay ng prangkisa dahil “private law” daw ito.
“A franchise is what is called a private law which applies only to an individual or group of individuals such as a corporation. A private law does not fall under any of the above [qualifications],” giit ni Angeles.
Pinagtawanan naman ni Caloocan City Prosecutor Darwin Cañete ang planong ito. Sana raw ay hinayaan nalang munang maisulong ang People's Initiative para mas naging katawa-tawa ito.
Isang pagkilala ang People’s Initiative sa karapatan at kapangyarihan ng mga Pilipino na direktang magpasa, magbasura, mag-amyenda o magsulong ng mga batas, ordinansa o resolusyon.
Para maipatupad ang People’s Initiative, kailangang makakalap ng pirma ng 10 porsyento ng kabuuang bilang ng mga botante sa bansa, kung saan may representasyon dapat ang 3 porsyento ng bawat congressional district.
