Is a DAR Land Transfer Clearance still required?

YOU’RE BUYING AGRICULTURAL LAND.
The seller has a clean title.
The deed is ready.
Then someone tells you:
“Kailangan pa ng DAR Clearance.”
But wait.
DO YOU STILL NEED IT?
That is a question worth asking in 2026.
What if you are buying private agricultural land?
What if you are transferring agricultural land to another buyer?
What if the property is already titled?
What if you are preparing the documents for registration with the Registry of Deeds?
Is a DAR Land Transfer Clearance still required?
And if someone tells you:
“Hindi puwedeng i-register without DAR Clearance.”
Is that still the rule?
What does DOJ Opinion have to say about the continued requirement for a Land Transfer Clearance from DAR?
What does this mean for agricultural land acquisition, land transfers, title registration, and real estate due diligence?
And perhaps the more important question:
Before you buy or transfer agricultural land, what documents should your lawyer verify first?
This is especially important when the transaction involves substantial property, because a document that you thought was merely a formality can affect the timing and process of your transaction.
Read the law.
Read the DOJ Opinion.
Then use what you learn to ask your own lawyer better questions about your particular property and transaction.
Do your due diligence before you sign, pay, or transfer.

Think that agricultural land can be converted so easily?
You think getting a DAR CONVERSION AUTHORITY is so easy, cheap, and inexpensive?

You have money, and you want to invest in land.
You find a large tract of agricultural land because you are thinking about a future subdivision, residential development, commercial project, industrial project, resort, or other non-agricultural use.
Then you are told:
“Residential na ang zoning, sir.”
Before you invest, there are questions worth asking:
Is residential zoning enough?
What if the agricultural land has already been reclassified by the local government?
Is reclassification the same thing as conversion?
Are there limits on how much agricultural land may be reclassified?
What if the property is already covered by CARP?
What if there is already a Notice of Coverage?
What if the agricultural property is a commercial farm?
Can an application for conversion still be filed under these circumstances?
And perhaps the question that should come before the purchase:
What should you verify about the property before you put your money into the transaction?
A recent Supreme Court case involving large agricultural properties, LGU reclassification, CARP coverage, commercial farming, and land conversion raises these questions.
The point of reading the law and Supreme Court decisions is not to practice law by yourself.
It is to help you understand the issues well enough to ask your own lawyer the right questions about your rights, obligations, and risks before making a major real estate decision.
Do your due diligence before you invest.

You have money and you want to invest in land.
Large tracts of land are often agricultural lands.
Maybe you're thinking:
"I'll buy the land now, then develop it later."
A subdivision.
A resort.
A commercial complex.
An industrial project.
But be careful. You might lose your investment.
What if the land is classified as agricultural?
What if you bought it specifically because you intend to use it for a non-agricultural purpose?
What if the municipality has already reclassified the property for residential, commercial, or industrial use?
Is reclassification already enough?
What if the property has already been placed under CARP?
What if a Notice of Coverage was issued before you applied for conversion?
Can you still apply for conversion?
Can the DAR deny your application?
And if your application for conversion is denied, what should you do next?
These are some of the questions raised in today's Supreme Court case involving a 124-hectare property, agricultural land, CARP coverage, land use reclassification, and an application to convert agricultural land for residential use.
If you are considering purchasing agricultural land because you intend to develop it for residential, commercial, industrial, tourism, or another non-agricultural purpose, these are questions worth asking before you put your money into the transaction.

You bought agricultural land because you plan to build a resort, subdivision, warehouse, factory, or commercial project. What should you ask BEFORE you buy?
Can agricultural land simply be used for a non-agricultural project?
What is the difference between agricultural land reclassification and land conversion?
If the local government has reclassified the area for residential, commercial, or industrial use, is that already enough?
Do you still need to check whether the property can actually be converted?
What if the land is covered by CARP?
What if the property is already titled?
What if the seller says, “The area is already commercial.”
What government records and approvals should you verify?
Should you investigate these issues before signing the Deed of Sale?
And if your plan is to develop the property, what should you ask your lawyer, geodetic engineer, and other professionals before putting substantial money into the land?
These are some of the questions raised in today's Supreme Court case involving agricultural land and its use for non-agricultural purposes.
If you are investing in agricultural land with the intention of eventually developing it for residential, commercial, industrial, tourism, or other non-agricultural purposes, these questions are worth asking before you commit to the purchase.

??1Can one person own or retain more than 5 hectares of agricultural land in the Philippines?
What happens if you own 10 hectares?
20 hectares?
50 hectares?
Can you simply sell the excess land?
Can a series of sales affect the portion you are allowed to retain?
What if the land was acquired through inheritance?
What if the property has already been covered by CARP?
What if you are planning to buy agricultural land from an existing landowner?
What should you verify before completing the transaction?
And what happens when DAR coverage, retention rights, previous transfers, and farmer-beneficiary claims all become involved?
These are some of the questions raised in today's Supreme Court case involving agricultural land, CARP coverage, landowner retention, transfers of agricultural land, and agrarian reform beneficiaries.
If you own, are inheriting, or are planning to buy agricultural land, the 5-hectare issue is something worth asking about before making a major property decision.

Your neighbor says you built on his land. What should you do next?
Is it really a boundary dispute?
Can the issue be resolved by simply looking at the land title?

These are some of the important legal questions discussed in today's Supreme Court case.
