Ten (10) years ago, I was just a guy delivering medical supplies on a motorcycle with a friend — under the heat of the sun and rain of typhoons. No big capital. No fancy office. Just a dream and a decision to keep moving forward.

The Philippines is once again filled with loud headlines, heated debates, and endless online arguments. Politics, Senate tensions, national issues — they’re everywhere you scroll.

As an aspiring lawyer and CEO with over ten (10) years of experience building businesses here in the Visayas, it’s my duty to help fellow entrepreneurs secure their land the RIGHT way.
Many businessmen unknowingly hold “imperfect titles” — lands they’ve occupied for years but don’t have a clean Torrens title yet.
RA 11573 makes this easier. Here are the 7 simple steps to confirm an imperfect title in the Visayas (based on RA 11573 + Supreme Court guidance in Republic v. Pasig Rizal Co.): 🇵🇭
Step 1: Check if your land qualifies
Your land must be:
• Agricultural public land that is “alienable and disposable” (A&D)
• You (or your predecessors) must have openly, continuously, exclusively, and notoriously possessed it for at least 20 years under a genuine belief you own it
Max size: 12 hectares.
If yes → proceed. This is the big change brought by RA 11573.
Step 2: Hire a licensed geodetic engineer
Get your land surveyed. The engineer will prepare a technical description and survey plan.
In the Visayas, you can find DENR-accredited surveyors in Cebu, Tacloban, or your provincial PENRO/CENRO office. This plan is the foundation of your application.
Step 3: Secure the DENR certification (the easiest part now)
Under RA 11573, you no longer need complicated papers from the DENR Secretary.
A simple certification from a DENR geodetic engineer stating the land is A&D is enough. This certification is printed directly on your survey plan.
(The Supreme Court in Republic v. Pasig Rizal confirmed this simplified proof is valid.)
Step 4: Gather strong proof of your 20-year possession
Collect:
• Old tax declarations in your name or your family’s
• Affidavits from neighbors, barangay officials, or long-time residents
• Photos, receipts for improvements, or planting records
This shows you treated the land as your own for 20+ years.
Step 5: File the petition in court
Go to the Regional Trial Court (RTC) in the province where the land is located (e.g., RTC Tacloban, Cebu, Samar, etc.).
File your Application for Confirmation of Imperfect Title + all documents. Pay the filing fees and have the case published in a newspaper.
Step 6 & 7: Attend the hearing → Get your title
The court will set a hearing. The Republic (via OSG) may oppose, but with proper documents under RA 11573, approval is much smoother now.
Once the court grants your petition, bring the decision to the Registry of Deeds to get your Torrens Title.
Businessmen: Secure legal land = easier loans, investments, and peace of mind.

Good news: In 2026, it’s now easier! The DTI just launched a ₱4-billion MSME Business Fund with up to ₱5M no-collateral loans + 1-year grace period.
Here are the 7 legal & practical steps to unlock funding: 🇵🇭💰
Step 1: Fix your imperfect land title (or prepare alternatives)
You don’t always need a perfect title anymore. Under RA 11573, you can confirm your land with just 20 years of open possession + a simple DENR geodetic engineer certification.
This makes you “bankable” faster. Even without title, many programs now accept other proofs. Start here if you own land.
Step 2: Get your business properly registered
Make sure you have:
• DTI/SEC registration
• Mayor’s Business Permit (from your city hall – Tacloban BPLD, etc.)
• Barangay Clearance
These are basic requirements for the new DTI MSME Fund and almost all loans. Do this first — it only takes days.
Step 3: Make your BIR records clean and audit-proof
Banks and DTI check your tax compliance. Keep:
• Daily entries in your columnar books (Sales & Purchases)
• Official receipts for every sale and from suppliers (prefer VAT-registered ones)
• Monthly/quarterly tax returns filed on time
Clean records = faster approval and no BIR LOA headaches.
Step 4: Prepare simple but strong documents
For the DTI MSME Business Fund (up to ₱5M no collateral):
• Valid ID
• Mayor’s Permit
• Proof of bank account
• Basic business plan (sales & how you’ll use the money)
Processing can be as fast as 7–10 days. Apply via sbcorp.gov.ph or your local Negosyo Center.
Step 5 & 6: Build good credit habits + explore Visayas options
Pay all bills and existing loans on time. Even small consistent payments help.
In Eastern Visayas, check:
• DTI/SB Corp regional offices
• Local banks with MSME windows
• Government programs for typhoon-affected areas
A lawyer review of your loan documents prevents unfair terms.
Step 7: Get expert help early

As an aspiring lawyer and CEO with more than ten (10) years of experience who leases commercial spaces in the Visayas, I always remind fellow businessmen: a weak lease agreement can shut down your store or cost you big money.
Whether you’re opening in Tacloban, Catbalogan, Baybay, Ormoc, or any Eastern Visayas city, here are the 7 simple legal steps to secure your commercial space lease the right way (based on the New Civil Code + local ordinances): 🇵🇭⚖️
Step 1: Verify the lessor really owns the space
Ask for the owner’s Transfer Certificate of Title (TCT) or latest Tax Declaration. Make sure they have the legal right to lease it to you.
In Tacloban, also check the zoning — your business type must match the city’s allowed use (get a Locational Clearance early to avoid problems later).
Step 2: Agree on the important details first
Under the Civil Code, commercial leases are freely negotiated. Clearly agree on:
• Exact start and end date (usually 3, 5 or 10 years)
• Monthly rent and any increase
• Who pays for electricity, water, internet, and garbage
Put everything in writing — verbal promises won’t hold up.
Step 3: Define who pays what — utilities, taxes, and repairs
Decide clearly:
• Electricity, water, and other utilities
• Real Property Tax (RPT)
• VAT and local business taxes
Many Visayas leases are “triple net” (you pay almost everything). Spell this out so there are no surprise bills later.
Step 4: Put everything in a complete written Contract of Lease
The contract should cover rent, timeframe, utilities, taxes, repairs, early termination rules, subleasing, and what happens during typhoons or building damage.
For leases longer than 1 year, the Civil Code strongly recommends a written contract. This protects both sides.
Step 5: Get the contract notarized
Take the signed contract to a notary public. A notarized lease becomes a public document — much stronger and easier to enforce in court if disputes arise.
Notarization is quick and inexpensive but gives you real peace of mind.
Step 6 & 7: Register and secure your business permits
For leases over 1 year, register a copy with the Registry of Deeds (this protects you if the property is sold).
Then use your notarized contract to apply for your Mayor’s Permit at Tacloban BPLD (or your city hall). You’ll also need Barangay Clearance, Fire Safety Inspection Certificate (FSIC), and Sanitary Permit.
A clean, legal lease means fewer headaches, easier loans, and smoother operations.
