◾️However, as Shaykh al-Fawzan says that the person is Mushrik with the 'awaam and with the 'ulamaa, and then in the 2nd question, he says that the hukm of riddah is given by the qaadi. Does the shaykh mean that you can call him a mushrik but the punishment will be given by the judge?

The entire speech by the Allaamah Al-Fawzaan Hafidhahullah, for those that don't know Arabic is as follows:

[Questioner 1] O Fadeelatush-Shaykh, may Allah grant you success, he says: "Is the ruling upon a Mushrik, or rather is the ruling upon a person being a Mushrik for the scholars also or is it for the layfolk if they see someone fall into Shirk to say about them "they are a Disbeliever and a Mushrik"?

[Answer 1] "Whoever manifest Shirk, they are a Mushrik. Whoever calls upon other than Allah, sacrifices to other than Allah and vows to other than Allah, this is a Mushrik. With the laymen and according to the scholars.

If he says: O Ali, O Hussein, this is a Mushrik. Everyone knows that they are a Mushrik. Yes".

[Question 2] O Fadeelatush-Shaykh, may Allah grant you success. One of the students of knowledge says, and whilst he was explaining that whoever falls into Shirk being a Disbeliever. He said, but the one who judges disbelief upon them and apostasy, this is does not belong to just anyone, not even the scholar and the Imam in knowledge, but rather to the judge because...

Shaykh interrupted: "The ruling of apostacy is with the Judge because he will be killed. But to say that this is Shirk. All say this. All that have Eemaan says this is Shirk. There is no need to go to a judge".

His statement:
"Whoever manifest Shirk, they are a Mushrik. Whoever calls upon other than Allah, sacrifices to other than Allah and vows to other than Allah, this is a Mushrik. With the laymen and according to the scholars.

This is clear in what I was establishing in the differentiation between the manifest clear-cut affairs; which a beginner student or a layfolk can participate in, and the obscured intricate affairs which are for the people of knowledge.

◾️Does the shaykh mean that you can call him a mushrik but the punishment will be given by the judge?

This is what appears to be the case when one looks at the question and answer together in light what preceded it, one finds that this is relating to the implementation of the punishment, and Allah knows best.

This is due to what has come in the question:

"One of the students of knowledge says, and whilst he was explaining that whoever falls into Shirk being a Disbeliever. This is does not belong to just anyone, not even the scholar and the Imam in knowledge, but rather to the judge because...".

And also what has come in the answer of the Shaykh:

"...because he will be killed".

And Allah knows best.

{ وَعِبَادُ ٱلرَّحۡمَٰنِ ٱلَّذِينَ يَمۡشُونَ عَلَى ٱلۡأَرۡضِ هَوۡنٗا وَإِذَا خَاطَبَهُمُ ٱلۡجَٰهِلُونَ قَالُواْ سَلَٰمٗا }

Muhsin Khan and Taqi-ud-Din al-Hilali:
And the slaves of the Most Beneficent (Allah) are those who walk on the earth in humility and sedateness, and when the foolish address them (with bad words) they reply back with mild words of gentleness.



Retaliating The Ignorant

بســـم اللــه الرحــمــن الـرحـــيــم

That is they respond with a response safe from sins and safe from retaliating the ignorant with his ignorance.

And this is a praise for them, due to their much forbearance and retaliation of evil with excellence and forgiving the ignorant and composure of the intellect which reaches them to that situation.

THE DAYS OF EATING DRINKING AND REMEMBERING ALLAAH

The days of Tashriq are the 11th, 12th and 13th of Dhul-Hijjah .

The Prophet (peace and blessings of Allaah be upon him) forbade fasting on these days :

“Do not fast on these days, for they are the days of eating, drinking and remembering Allaah.”

Narrated by Ahmad, 10286; classed as sahih by al-Albani in al-Silsilah al-Sahihah, 3573.
