*Part I: INTRODUCTION*
There are some areas of law that do sound abstract even to the learned minds, how more to the masses who are not lawyers. One of such areas is the field of Intellectual Property. To make it more complex, let talk about it as Intellectual Property Law or as Intellectual Property Rights. Another complexity is to think of Intellectual Property as a sister of Copyright. Thus, how can this subject be understood as par what it really is all about?
*Part II: WHAT INTELLECTUAL PROPERTY CONNOTES*
To start with, Intellectual Property connotes the recognition accorded to any product of one's brain (intellect) as a "property" whose ownership can be claimed and all rights incidental thereto can be enjoyed and enforced if trampled upon.
On its own, Intellectual Property Rights are the legion of such rights attached to the Intellectual Property while the Intellectual Property Law are the body of rules and regulations laid down to protect those rights for their owners.
Let me also quickly state that Copyright is not the same or a sister to Intellectual Property. Rather, it is one of the dimensions of the rights recognized for the Intellectual Property. Put more concisely, Copyright is a type of Intellectual Property Rights.
Generally, Intellectual Property can be a product of the intellect in variant dimensions be it as a product of science, art, design; etc.
*Part II: CONSTITUENTS OF INTELLECTUAL PROPERTY RIGHTS*
What constitute Intellectual Property Rights (otherwise always simply called Intellectual Property) include but not limited to: Copyright; Trademark; Industrial Design; Trade Secrets; Animal Variety; Patents; Show-How; etc.
The following terms must be noted:
1. Intellectual Property
2. Intellectual Property Rights
3. Intellectual Property Law
Appreciating the above concepts as earlier clarified, should make it comprehended that Intellectual Property Rights; though simply called Intellectual Property (IP), inter alia, are:
1. Copyright
2. Trade Marks
3. Patents
4. Industrial Designs
5. Trade Secrets
6. Know-How
7. Animal/Plant Variety
8. Show-How; etc.
All the above IP rights are variously attached to different products of the intellect and there are circumstances when two or more of them may be combined for the protection of a particular IP. For instance, even though for scientific inventions, the appropriate right is Patent; but for such Inventions also published as a write up, that publication would also be accorded the IP right of Copyright.
*Part IV: CONCLUSION*
Given that Intellectual Property is an intangible property; an abstract property; as different from tangible properties; those IP rights have been developed to protect them. Now, to understand what IP sets out over the years to do for their creators; which is to make them enjoy the fruits of their own labour and have value for their production, economically and socially; we would appreciate that if not for the IP, so many intellectual products may not bring any economic benefits to their creators.
Accordingly, it would be on point to understand IP as the tool by which knowledge can be a business which can be traded or have consideration advanced for it without any query to the owner of such knowledge. It is through IP that packaging and branding become engagements to be undertaken for a living.
Premised on the foregoing, there is need for various programs of studies in institutions of higher learning to incorporate into their curricula trainings in the business of knowledge being impacted on their students. NUC and other stakeholders in the education sector should be charged with this repsonsibiliy for a change. This is one way by which more job creators can be created as against the increasing rise in the number of job seekers being produced daily. This will entail training students in the entrepreneurship skills as specific to their fields (e.g. Legal Entrepreneurship; Engineering Entrepreneurship; Accounting Entrepreneurship; etc). Litigation and the routine legal services may not strictly speaking constitute the only Legal entrepreneurship law students need to be exposed to; which seems to be the core focus of Law Clincs.
It therefore follows logically that all students should be exposed to basic knowledge of Intellectual Property. Doing this would go a long way to make more people(intellectuals) get value for the products of their Intellectual efforts in appreciating that such are enough as properties as worthy of ownership; worthy of making a living from.
