HUDUBAR ANNABI MUHAMMAD SALLALLAHU ALAIHI WASALLAM WANDA YAYI A KHUDUBAR RANAR TARA GA WATAN ZUL-HIJJAH, SHEKARA TA GOMA DA HIJIRA A DUTSEN ARAFAT (RANAR ARFA KENAN).
ANNABI (SAW)YA FARA DACEWA:
“Ya ku MUTANE ku bani hankalinku, domin mai Yiwuwa bazan sake kasancewa da ku bayan wannan shekaran ba, saboda haka ku saurari abinda nake gaya maku da kyau, kuma (ku isar da abinda zan gaya maku) ga wadanda basa wannan wuri a yau.
Ya ku mutane kamar yadda kuka riki wannan wata, (NA HAJJI) da wannan rana (TA ARFA) da kuma wannan gari (NA MAKKA ) da GIRMA kuma abin TSAREWA, to haka kuma ku riki Ran MUSULMI da kuma DUKIYOYINSU da girma abin kuma karewa, ku maida wa Mutane kayan da s**a baku AMANA. Kar ku CUCI kowa, saboda kar wasu su cuce ku, ku tuna fa, hakika ALLAH zai yi sakayya akan ayukakanku, ALLAH (SWT) ya hana cin riba,(wato KUDIN RUWA) saboda haka, duk abin da aka kulla ta kudin ruwa sai an warware shi.
Ku yi hattara da SHAIDAN, domin kiyaye ADDININKU. Yanzu kan ya fidda ran batar da ku akan manyan abubuwa (na sabo) saboda haka ku guji binshi akan kanana.
Ya ku jamaa hakika kuna da hakki bisa MATAYENKU, amma suma suna da hakki bisa kanku, to hakkin su ne akanku da KUCIYAR dasu, Kuma ku TUFATAR dasu akan jin kai. ku bi dasu kyakkyawan biyarwa, ku kuma tausasa musu domin su majibintan al amurran kune, kuma mataimakan ku, Hakki ne akansu da kar su yi abota da duk wanda ba kwa so, kuma su nisanci ZINA.
Ya ku jama'a kuyi kyakkyawan bauta ga ALLAH (SWT) ku tsaida SALLOLI biyar(5) na farilla, Ku AZUMCI Watan RAMADAN ku Kuma bada ZAKKA. Ku aikata aikin HAJJI in har kun sami daman yi. KU SANI FA, ko wane musulmi dan uwan musulmi ne. Dukkan ku dai dai kuke. Ba wanda yake da fifiko saman wani sai ta tsoron ALLAH, da aikata kyawawan ayyukka.
Ku tuna fa(ya ku jama'a) wata rana za ku tsaya gaban UBANGIJINKU, domin sakamakon ayyukanku, saboda haka ku yi hattara kada ku yi sake da hanya MADAIDAICIYA bayan na kau.
Ya ku jama'a ba wani ANNABI ko MANZO da zai zo bayana kuma babu wani ADDINI da zai zo (bayan addinin MUSULUNCI), saboda haka kuyi tunani sosai akan wannan magana dana gaya maku, kuma ku fahimce ta (sosai).
Zan bar maku abubuwa guda biyu (2); ga (ALKUR'ANI) ga kuma (SUNNAH) ta. In kun bi wannan ba za ku ta ba bata ba. Duk Wanda ya ji wannan sako to ya jiyar da wadansu, suma su jiyar da wasunsu, kuma sau da yawa wadanda za su ji magana daga karshe sufi masu ji na yanzu fahimtar abinda nake fada.
YA ALLAH ka zamo shaida agareni, cewa na isar da aikenka zuwa ga bayinka.”
Yan uwa ku watsa wannan KHUDUBAR ga yan uwa musulmi wanda kamar yau akayi ta!!!
Allah duk wanda ya tura wannan khuduba ya Allah ka sadashi da annabin Muhammad (saw),ya Allah kabiya masa dukkan bukatunsa na alkhairi.

ﺗﺪﺧﻞ ﻓﻲ ﺣﻜﻢ ﺷﺮﻋﻲ ﻣﺮﺟﻌﻪ ﺇﻟﻰ ﺃﻫﻞ ﺍﻟﻌﻠﻢ ﻭﻋﻠﻰ ﺿﻮﺀ ﺍﻟﻜﺘﺎﺏ ﻭﺍﻟﺴﻨﺔ .ﻭﻟﻴﺲ ﻓﻲ ﺍﻟﺸﺮﻳﻌﺔ ﻣﺎ ﻳﺤﺪﺩ ﺍﻟﺴﻦ ﺍﻟﺬﻱ ﺗﺰﻭﺝ ﻓﻴﻪ ﺍﻟﻔﺘﺎﺓ . ﺑﻞ ﻓﻲ ﺍﻟﺸﺮﻳﻌﺔ ﻣﺎ ﻳﺪﻝ ﻋﻠﻰ ﺧﻼﻑ ﺫﻟﻚ ﻗﺎﻝ ﺍﻟﻠﻪ ﺗﻌﺎﻟﻰ ﻓﻲ ﻋﺪﺓ ﺍﻟﻤﻄﻠﻘﺔ : ) ﻭَﺍﻟﻼَّﺋِﻲ ﻳَﺌِﺴْﻦَ ﻣِﻦْ ﺍﻟْﻤَﺤِﻴﺾِ ﻣِﻦْ ﻧِﺴَﺎﺋِﻜُﻢْ ﺇِﻥْ ﺍﺭْﺗَﺒْﺘُﻢْ ﻓَﻌِﺪَّﺗُﻬُﻦَّ ﺛَﻼﺛَﺔُ ﺃَﺷْﻬُﺮٍ ﻭَﺍﻟﻼَّﺋِﻲ ﻟَﻢْ ﻳَﺤِﻀْﻦَ ( ، ﺃﻱ ﺍﻟﺼﻐﻴﺮﺍﺕ ﺍﻟﻼﺗﻲ ﻟﻢ ﻳﺒﻠﻐﻦ ﺳﻦ ﺍﻟﺤﻴﺾ ﻓﻌﺪﺗﻬﻦ ﺛﻼﺛﺔ ﺃﺷﻬﺮ ﻣﺜﻞ ﺍﻟﻴﺎﺋﺴﺎﺕ ﻣﻦ ﺍﻟﺤﻴﺾ ﻓﻬﺬﺍ ﺩﻟﻴﻞ ﻣﻦ ﺍﻟﻘﺮﺁﻥ ﻋﻠﻰ ﺃﻥ ﺍﻟﺼﻐﻴﺮﺓ ﺗﺰﻭﺝ ﻭﺗﻄﻠﻖ ﻭﺗﻠﺰﻣﻬﺎ ﺍﻟﻌﺪﺓ . ﻭﻗﺪ ﺩﻟﺖ ﺍﻟﺴﻨﺔ ﻋﻠﻰ ﺫﻟﻚ ﻓﻘﺪ ﺗﺰﻭﺝ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻋﺎﺋﺸﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﺎ ﻭﻫﻲ ﺑﻨﺖ ﺳﺖ ﺳﻨﻴﻦ . ﻭﺩﺧﻞ ﺑﻬﺎ ﻭﻫﻲ ﺑﻨﺖ ﺗﺴﻊ ﺳﻨﻴﻦ ﻓﻬﺬﺍ ﺩﻟﻴﻞ ﻣﻦ ﺍﻟﺴﻨﺔ ﻋﻠﻰ ﻫﺬﻩ ﺍﻟﻤﺴﺄﻟﺔ ﻭﻗﺪ ﺃﺟﻤﻊ ﺍﻟﻌﻠﻤﺎﺀ ﻋﻠﻰ ﺟﻮﺍﺯ ﺫﻟﻚ . ﻗﺎﻝ ﺍﻹﻣﺎﻡ ﺍﻟﺒﺨﺎﺭﻱ ﺭﺣﻤﻪ ﺍﻟﻠﻪ ﻓﻲ ﺻﺤﻴﺤﻪ : ﺑﺎﺏ ﺇﻧﻜﺎﺡ ﺍﻟﺮﺟﻞ ﻭﻟﺪﻩ ﺍﻟﺼﻐﺎﺭ . ﻟﻘﻮﻟﻪ ﺗﻌﺎﻟﻰ : ) ﻭَﺍﻟﻼَّﺋِﻲ ﻟَﻢْ ﻳَﺤِﻀْﻦَ ( ، ﻓﺠﻌﻞ ﻋﺪﺗﻬﺎ ﺛﻼﺛﺔ ﺃﺷﻬﺮ ﻗﺒﻞ ﺍﻟﺒﻠﻮﻍ . ﺣﺪﺛﻨﺎ ﻣﺤﻤﺪ ﺑﻦ ﻳﻮﺳﻒ ﺣﺪﺛﻨﺎ ﺳﻔﻴﺎﻥ ﻋﻦ ﻫﺸﺎﻡ ﻋﻦ ﺃﺑﻴﻪ ﻋﻦ ﻋﺎﺋﺸﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﺎ : ﺃﻥ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﺗﺰﻭﺟﻬﺎ ﻭﻫﻲ ﺑﻨﺖ ﺳﺖ ﺳﻨﻴﻦ ﻭﺃﺩﺧﻠﺖ ﻋﻠﻴﻪ ﻭﻫﻲ ﺑﻨﺖ ﺗﺴﻊ ﻭﻣﻜﺜﺖ ﻋﻨﺪﻩ ﺗﺴﻌﺎً ﻗﺎﻝ ﺍﻟﺤﺎﻓﻆ ﺍﺑﻦ ﺣﺠﺮ ﺭﺣﻤﻪ ﺍﻟﻠﻪ ﻓﻲ ﺍﻟﻔﺘﺢ : ﻗﻮﻟﻪ : ﻟﻘﻮﻝ ﺍﻟﻠﻪ ﺗﻌﺎﻟﻰ : ) ﻭَﺍﻟﻼَّﺋِﻲ ﻟَﻢْ ﻳَﺤِﻀْﻦَ ( ، ﻓﺠﻌﻞ ﻋﺪﺗﻬﺎ ﺛﻼﺛﺔ ﺃﺷﻬﺮ ﻗﺒﻞ ﺍﻟﺒﻠﻮﻍ ﺃﻱ ﻓﺪﻝ ﻋﻠﻰ ﺃﻥ ﻧﻜﺎﺣﻬﺎ ﻗﺒﻞ ﺍﻟﺒﻠﻮﻍ ﺟﺎﺋﺰ ﻭﻫﻮ ﺍﺳﺘﻨﺒﺎﻁ ﺣﺴﻦ ﻟﻜﻦ ﻟﻴﺲ ﻓﻲ ﺍﻵﻳﺔ ﺗﺨﺼﻴﺺ ﺫﻟﻚ ﺑﺎﻟﻮﺍﻟﺪ ﻭﻻ ﺑﺎﻟﺒﻜﺮ . ﻭﻳﻤﻜﻦ ﺃﻥ ﻳﻘﺎﻝ ﺍﻷﺻﻞ ﻓﻲ ﺍﻷﺑﻀﺎﻉ ﺍﻟﺘﺤﺮﻳﻢ ﺇﻻ ﻣﺎ ﺩﻝ ﻋﻠﻴﻪ ﺍﻟﺪﻟﻴﻞ ﻭﻗﺪ ﻭﺭﺩ ﺣﺪﻳﺚ ﻋﺎﺋﺸﺔ ﻓﻲ ﺗﺰﻭﻳﺞ ﺃﺑﻲ ﺑﻜﺮ ﻟﻬﺎ ﻭﻫﻲ ﺩﻭﻥ ﺍﻟﺒﻠﻮﻍ ﻓﺒﻘﻲ ﻣﺎ ﻋﺪﺍﻫﺎ ﻋﻠﻰ ﺍﻷﺻﻞ . ﻭﻟﻬﺬﺍ ﺍﻟﺴﺮ ﺃﻭﺭﺩ ﺣﺪﻳﺚ ﻋﺎﺋﺸﺔ ﻗﺎﻝ ﺍﻟﻤﻬﻠﺐ : ﺃﺟﻤﻌﻮﺍ ﺃﻧﻪ ﻳﺠﻮﺯ ﻟﻸﺏ ﺗﺰﻭﻳﺞ ﺍﺑﻨﺘﻪ ﺍﻟﺼﻐﻴﺮﺓ ﻭﻟﻮ ﻛﺎﻧﺖ ﻻ ﻳﻮﻃﺄ ﻣﺜﻠﻬﺎ : ﺍﻧﺘﻬﻰ ﻣﻦ ﺍﻟﺠﺰﺀ ﺍﻟﺘﺎﺳﻊ ﻣﻦ ﻓﺘﺢ ﺍﻟﺒﺎﺭﻱ ﺻﻔﺤﺔ .190 -189 ﻭﻗﺎﻝ ﺍﺑﻦ ﺑﻄﺎﻝ ﻓﻲ ﺷﺮﺣﻪ ﻟﺼﺤﻴﺢ ﺍﻟﺒﺨﺎﺭﻱ ﻓﻲﺻﻔﺤﺔ 173 – 172 ﻋﻠﻰ ﺑﺎﺏ ﺗﺰﻭﻳﺞ ﺍﻟﺼﻐﺎﺭ ﻣﻦ ﺍﻟﻜﺒﺎﺭ : ﺃﺟﻤﻊ ﺍﻟﻌﻠﻤﺎﺀ ﻋﻠﻰ ﺃﻧﻪ ﻳﺠﻮﺯ ﻟﻶﺑﺎﺀ ﺗﺰﻭﻳﺞ ﺍﻟﺼﻐﺎﺭ ﻣﻦ ﺑﻨﺎﺗﻬﻢ ﻭﺇﻥ ﻛﻦ ﻓﻲ ﺍﻟﻤﻬﺪ ﺇﻻ ﺃﻧﻪ ﻻ ﻳﺠﻮﺯ ﻷﺯﻭﺍﺟﻬﻦ ﺍﻟﺒﻨﺎﺀ ﺑﻬﻦ ﺇﻻ ﺇﺫﺍ ﺻﻠﺤﻦ ﻟﻠﻮﻁﺀ ﻭﺍﺣﺘﻤﻠﻦ ﺍﻟﺮﺟﺎﻝ ﻭﺃﺣﻮﺍﻟﻬﻦ ﺗﺨﺘﻠﻒ ﻓﻲ ﺫﻟﻚ ﻋﻠﻰ ﻗﺪﺭ ﺧﻠﻘﻬﻦ ﻭﻃﺎﻗﺘﻬﻦ . ﻭﻛﺎﻧﺖ ﻋﺎﺋﺸﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﺎ ﺣﻴﻦ ﺗﺰﻭﺝ ﺑﻬﺎ ﺍﻟﻨﺒﻲ ﺑﻨﺖ ﺳﺖ ﺳﻨﻴﻦ ﻭﺑﻨﻰ ﺑﻬﺎ ﺑﻨﺖ ﺗﺴﻊ ـ ﺍﻧﺘﻬﻰ . ﻭﻗﺎﻝ ﺍﻟﻤﻮﻓﻖ ﻓﻲ ﺍﻟﻤﻐﻨﻲ ﺷﺮﺡ ﻣﺨﺘﺼﺮ ﺍﻟﺨﺮﻗﻲ ﺍﻟﺠﺰﺀ ﺍﻟﺴﺎﺩﺱ ﺻﻔﺤﺔ :487 ﻣﺴﺄﻟﺔ : ) ﻭﺇﺫﺍ ﺯﻭﺝ ﺍﻟﺮﺟﻞ ﺍﺑﻨﺘﻪ ﺍﻟﺒﻜﺮ ﻓﻮﺿﻌﻬﺎ ﻓﻲ ﻛﻔﺎﻳﺔ ﻓﺎﻟﻨﻜﺎﺡ ﺛﺎﺑﺖ ﻭﺇﻥ ﻛﺮﻫﺖ ﻛﺒﻴﺮﺓ ﻛﺎﻧﺖ ﺃﻭ ﺻﻐﻴﺮﺓ ( ﻗﺎﻝ ﺍﻟﻤﻮﻓﻖ : ﺃﻣﺎ ﺍﻟﺒﻜﺮ ﺍﻟﺼﻐﻴﺮﺓ ﻓﻼ ﺧﻼﻑ ﻓﻴﻬﺎ . ﻗﺎﻝ ﺍﺑﻦ ﺍﻟﻤﻨﺬﺭ : ﺃﺟﻤﻊ ﻛﻞ ﻣﻦ ﻧﺤﻔﻆ ﻋﻨﻪ ﻣﻦ ﺃﻫﻞ ﺍﻟﻌﻠﻢ ﺃﻥ ﻧﻜﺎﺡ ﺍﻷﺏ ﺍﺑﻨﺘﻪ ﺍﻟﺒﻜﺮ ﺍﻟﺼﻐﻴﺮﺓ ﺟﺎﺋﺰ ﺇﺫﺍ ﺯﻭﺟﻬﺎ ﻣﻦ ﻛﻒﺀ ﻣﻊ ﻛﺮﺍﻫﻴﺘﻬﺎ ﻭﺍﻣﺘﻨﺎﻋﻬﺎ . ﻭﻗﺪ ﺩﻝ ﻋﻠﻰ ﺟﻮﺍﺯ ﺗﺰﻭﻳﺞ ﺍﻟﺼﻐﻴﺮﺓ ﻗﻮﻝ ﺍﻟﻠﻪ ﺗﻌﺎﻟﻰ : ) ﻭَﺍﻟﻼَّﺋِﻲ ﻳَﺌِﺴْﻦَ ﻣِﻦْ ﺍﻟْﻤَﺤِﻴﺾِ ﻣِﻦْ ﻧِﺴَﺎﺋِﻜُﻢْ ﺇِﻥْ ﺍﺭْﺗَﺒْﺘُﻢْ ﻓَﻌِﺪَّﺗُﻬُﻦَّ ﺛَﻼﺛَﺔُ ﺃَﺷْﻬُﺮٍ ﻭَﺍﻟﻼَّﺋِﻲ ﻟَﻢْ ﻳَﺤِﻀْﻦَ ( ، ﻓﺠﻌﻞ ﻟﻠﻼﺋﻲ ﻟﻢ ﻳﺤﻀﻦ ﻋﺪﺓ ﺛﻼﺛﺔ ﺃﺷﻬﺮ . ﻭﻻ ﺗﻜﻮﻥ ﺍﻟﻌﺪﺓ ﺛﻼﺛﺔ ﺃﺷﻬﺮ ﺇﻻ ﻣﻦ ﻃﻼﻕ ﻓﻲ ﻧﻜﺎﺡ ﺃﻭ ﻓﺴﺦ ﻓﺪﻝ ﺫﻟﻚ ﻋﻠﻰ ﺃﻧﻬﺎ ﺗﺰﻭﺝ ﻭﺗﻄﻠﻖ ﻭﻻ ﺇﺫﻥ ﻟﻬﺎ ﻓﻴﻌﺘﺒﺮ . ﻭﻗﺎﻟﺖ ﻋﺎﺋﺸﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﺎ : ﺗﺰﻭﺟﻨﻲ ﺭﺳﻮﻝ ﺍﻟﻠﻪ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻭﺃﻧﺎ ﺍﺑﻨﺔ ﺳﺖ ﻭﺑﻨﻰ ﺑﻲ ﻭﺃﻧﺎ ﺍﺑﻨﺔ ﺗﺴﻊ ﻣﺘﻔﻖ ﻋﻠﻴﻪ . ﻭﻣﻌﻠﻮﻡ ﺃﻧﻬﺎ ﻟﻢ ﺗﻜﻦ ﻓﻲ ﺗﻠﻚ ﺍﻟﺤﺎﻝ ﻣﻤﻦ ﻳﻌﺘﺒﺮ ﺇﺫﻧﻬﺎ ـ ﺍﻧﺘﻬﻰ . ﻭﻗﺎﻝ ﺍﻹﻣﺎﻡ ﺍﻟﻨﻮﻭﻱ ﺭﺣﻤﻪ ﺍﻟﻠﻪ ﻓﻲ ﺷﺮﺣﻪ ﻟﺼﺤﻴﺢ ﻣﺴﻠﻢ ﺍﻟﺠﺰﺀ ﺍﻟﺘﺎﺳﻊ ﺻﻔﺤﺔ :294 ﺑﺎﺏ ﺟﻮﺍﺯ ﺗﺰﻭﻳﺞ ﺍﻷﺏ ﺍﻟﺒﻜﺮ ﺍﻟﺼﻐﻴﺮﺓ . ﻓﻴﻪ ﺣﺪﻳﺚ ﻋﺎﺋﺸﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﺎ ﻗﺎﻟﺖ : ) ﺗﺰﻭﺟﻨﻲ ﺭﺳﻮﻝ ﺍﻟﻠﻪ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻟﺴﺖ ﺳﻨﻴﻦ ﻭﺑﻨﻰ ﺑﻲ ﻭﺃﻧﺎ ﺍﺑﻨﺔ ﺗﺴﻊ ﺳﻨﻴﻦ ﻭﻓﻲ ﺭﻭﺍﻳﺔ : ﺗﺰﻭﺟﻬﺎ ﻭﻫﻲ ﺑﻨﺖ ﺳﺒﻊ ﺳﻨﻴﻦ . ﻫﺬﺍ ﺻﺮﻳﺢ ﻓﻲ ﺟﻮﺍﺯ ﺗﺰﻭﻳﺞ ﺍﻷﺏ ﺍﻟﺼﻐﻴﺮﺓ ﺑﻐﻴﺮ ﺇﺫﻧﻬﺎ . ﻷﻧﻪ ﻻ ﺇﺫﻥ ﻟﻬﺎ . ﺇﻟﻰ ﺃﻥ ﻗﺎﻝ : ﻭﺃﺟﻤﻊ ﺍﻟﻤﺴﻠﻤﻮﻥ ﻋﻠﻰ ﺟﻮﺍﺯ ﺗﺰﻭﻳﺠﻪ ﺑﻨﺘﻪ ﺍﻟﺒﻜﺮ ﺍﻟﺼﻐﻴﺮﺓ ﻟﻬﺬﺍ ﺍﻟﺤﺪﻳﺚ ﺍﻧﺘﻬﻰ ﻭﻗﺎﻝ ﺍﻟﺸﻴﺦ ﻋﺒﺪﺍﻟﻌﺰﻳﺰ ﺑﻦ ﺑﺎﺯ ﺭﺣﻤﻪ ﺍﻟﻠﻪ ﻓﻲ ﻣﺠﻤﻮﻉ ﻓﺘﺎﻭﺍﻩ ﻭﻣﻘﺎﻻﺗﻪ ﺍﻟﺠﺰﺀ ﺍﻟﺮﺍﺑﻊ ﺻﻔﺤﺔ 126 ﻟﻤﺎ ﺑﻠﻐﻪ ﺃﻥ ﺑﻌﺾ ﺍﻟﺪﻭﻝ ﺍﻹﺳﻼﻣﻴﺔ ﺗﺮﻳﺪ ﺗﺤﺪﻳﺪ ﺳﻦ ﺍﻟﺰﻭﺍﺝ ﺑﺄﻥ ﻻ ﻳﻘﻞ ﻋﻤﺮ ﺍﻟﻔﺘﻰ ﻋﻦ ﺛﻤﺎﻧﻴﺔ ﻋﺸﺮ ﻋﺎﻣﺎ ﻭﻋﻤﺮ ﺍﻟﻔﺘﺎﺓ ﻋﻦ ﺳﺘﺔ ﻋﺸﺮ ﻋﺎﻣﺎ . ﻗﺎﻝ : ﻓﻠﻤﺎ ﻛﺎﻥ ﺫﻟﻚ ﻳﺨﺎﻟﻒ ﻣﺎ ﺷﺮﻋﻪ ﺍﻟﻠﻪ ﺟﻞ ﻭﻋﻼ ﺃﺣﺒﺒﺖ ﺍﻟﺘﻨﺒﻴﻪ ﻟﺒﻴﺎﻥ ﺍﻟﺤﻖ . ﻓﺎﻟﺴﻦ ﻓﻲ ﺍﻟﺰﻭﺍﺝ ﻟﻢ ﻳﻘﻴﺪ ﺑﺤﺪ ﻣﻌﻴﻦ ﻻ ﻓﻲ ﺍﻟﺒﻜﺮ ﻭﻻ ﻓﻲ ﺍﻟﺼﻐﻴﺮ . ﻭﺍﻟﻜﺘﺎﺏ ﻭﺍﻟﺴﻨﺔ ﻳﺪﻻﻥ ﻋﻠﻰ ﺫﻟﻚ . ﻷﻥ ﻓﻴﻬﻤﺎ ﺍﻟﺤﺚ ﻋﻠﻰ ﺍﻟﺰﻭﺍﺝ ﻭﺍﻟﺘﺮﻏﻴﺐ ﻓﻴﻪ ﻣﻦ ﺩﻭﻥ ﺗﻘﻴﻴﺪ ﺑﺴﻦ ﻣﻌﻴﻨﺔ . ﻗﺎﻝ ﺍﻟﻠﻪ ﺗﻌﺎﻟﻰ : ) ﻭَﻳَﺴْﺘَﻔْﺘُﻮﻥَﻙَ ﻓِﻲ ﺍﻟﻨِّﺴَﺎﺀِ ﻗُﻞْ ﺍﻟﻠَّﻪُ ﻳُﻔْﺘِﻴﻜُﻢْ ﻓِﻴﻬِﻦَّ ﻭَﻣَﺎ ﻳُﺘْﻠَﻰ ﻋَﻠَﻴْﻜُﻢْ ﻓِﻲ ﺍﻟْﻜِﺘَﺎﺏِ ﻓِﻲ ﻳَﺘَﺎﻣَﻰ ﺍﻟﻨِّﺴَﺎﺀِ ﺍﻟﻼَّﺗِﻲ ﻻ ﺗُﺆْﺗُﻮﻧَﻬُﻦَّ ﻣَﺎ ﻛُﺘِﺐَ ﻟَﻬُﻦَّ ﻭَﺗَﺮْﻏَﺒُﻮﻥَ ﺃَﻥْ ﺗَﻨﻜِﺤُﻮﻫُﻦَّ ( ﺍﻵﻳﺔ . ﻓﺄﺟﺎﺯ ﻧﻜﺎﺡ ﺍﻟﻴﺘﻴﻤﺔ ﻭﻫﻲ ﻟﻢ ﺗﺒﻠﻎ ﺳﻦ ﺍﻟﺒﻠﻮﻍ . ﻭﺃﻋﻼﻩ ﺧﻤﺴﺔ ﻋﺸﺮ ﻋﺎﻣﺎ ﻋﻠﻰ ﺍﻷﺭﺟﺢ . ﻭﻗﺪ ﺗﺒﻠﻎ ﺑﺄﻗﻞ ﻣﻦ ﺫﻟﻚ ﺍﻟﺴﻦ ﻭﻗﺎﻝ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ " : ﺗﺴﺘﺄﺫﻥ ﺍﻟﻴﺘﻴﻤﺔ ﻓﻲ ﻧﻔﺴﻬﺎ ﻓﺈﻥ ﺳﻜﺘﺖ ﻓﻬﻮ ﺇﺫﻧﻬﺎ ﻭﺇﻥ ﺃﺑﺖ ﻓﻼ ﺟﻮﺍﺯ ﻋﻠﻴﻬﺎ " ، ﻭﻗﺪ ﺗﺰﻭﺝ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ ﻋﺎﺋﺸﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﺎ ﻭﻟﻬﺎ ﺳﺖ ﺃﻭ ﺳﺒﻊ ﺳﻨﻴﻦ . ﻭﺩﺧﻞ ﺑﻬﺎ ﻭﻫﻲ ﺍﺑﻨﺔ ﺗﺴﻊ . ﻭﻓﻌﻠﻪ ﺗﺸﺮﻳﻊ ﻟﻬﺬﻩ ﺍﻷﻣﺔ . ﻛﻤﺎ ﺃﻥ ﺍﻟﺼﺤﺎﺑﺔ ﺭﺿﻲ ﺍﻟﻠﻪ ﻋﻨﻬﻢ ﻛﺎﻧﻮﺍ ﻳﺘﺰﻭﺟﻮﻥ ﻓﻲ ﺍﻟﺼﻐﺮ ﻭﻓﻲ ﺍﻟﻜﺒﺮ ﺩﻭﻥ ﺗﺤﺪﻳﺪ ﺳﻦﻣﻌﻴﻨﺔ . ﻓﻠﻴﺲ ﻷﺣﺪ ﺃﻥ ﻳﺸﺮﻉ ﻏﻴﺮ ﻣﺎ ﺷﺮﻋﻪ ﺍﻟﻠﻪ ﻭﺭﺳﻮﻟﻪ ﻷﻥ ﻓﻴﻪ ﺍﻟﻜﻔﺎﻳﺔ . ﻭﻣﻦ ﺭﺃﻯ ﺧﻼﻑ ﺫﻟﻚ ﻓﻘﺪ ﻇﻠﻢ ﻧﻔﺴﻪ ﻭﺷﺮﻉ ﻟﻠﻨﺎﺱ ﻣﺎ ﻟﻢ ﻳﺄﺫﻥ ﺑﻪ ﺍﻟﻠﻪ . ﻭﻗﺪ ﻗﺎﻝ ﻋﺰ ﻭﺟﻞ ﺫﺍﻣﺎ ﻟﻬﺬﺍ ﺍﻟﺼﻨﻒ ﻣﻦ ﺍﻟﻨﺎﺱ : ) ﺃَﻡْ ﻟَﻬُﻢْ ﺷُﺮَﻛَﺎﺀُ ﺷَﺮَﻋُﻮﺍ ﻟَﻬُﻢْ ﻣِﻦْ ﺍﻟﺪِّﻳﻦِ ﻣَﺎ ﻟَﻢْ ﻳَﺄْﺫَﻥْ ﺑِﻪِ ﺍﻟﻠَّﻪُ ( ﺍﻵﻳﺔ . ﻭ ﻗﺎﻝ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﻋﻠﻴﻪ ﻭﺳﻠﻢ " : ﻣﻦ ﺃﺣﺪﺙ ﻓﻲ ﺃﻣﺮﻧﺎ ﻫﺬﺍ ﻣﺎ ﻟﻴﺲ ﻣﻨﻪ ﻓﻬﻮ ﺭﺩ " ، ﻣﺘﻔﻖ ﻋﻠﻴﻪ . ﻭﻓﻲ ﺭﻭﺍﻳﺔ ﻣﺴﻠﻢ " : ﻣﻦ ﻋﻤﻞ ﻋﻤﻼ ﻟﻴﺲ ﻋﻠﻴﻪ ﺃﻣﺮﻧﺎ ﻓﻬﻮ ﺭﺩ " ، ﻭﻋﻠﻘﻪ ﺍﻟﺒﺨﺎﺭﻱ ﻓﻲ ﺍﻟﺼﺤﻴﺢ ﺟﺎﺯﻣﺎ ﺑﻪ . ﻭﺇﻧﻨﻲ ﺃﺫﻛﺮ ﺍﻟﻘﺎﺋﻤﻴﻦ ﻓﻲ ﻫﺬﺍ ﺍﻷﻣﺮ ﺑﻘﻮﻝ ﺍﻟﻠﻪ ﺗﻌﺎﻟﻰ : ) ﻓَﻠْﻴَﺤْﺬَﺭْ ﺍﻟَّﺬِﻳﻦَ ﻳُﺨَﺎﻟِﻔُﻮﻥَ ﻋَﻦْ ﺃَﻣْﺮِﻩِ ﺃَﻥْ ﺗُﺼِﻴﺒَﻬُﻢْ ﻓِﺘْﻨَﺔٌ ﺃَﻭْ ﻳُﺼِﻴﺒَﻬُﻢْ ﻋَﺬَﺍﺏٌ ﺃَﻟِﻴﻢٌ ( ﻓﻤﺎ ﻳﺼﻴﺐ ﺍﻷﻣﺔ ﺃﻭ ﺍﻷﻓﺮﺍﺩ ﻣﻦ ﻓﺘﻦ ﺃﻭ ﺻﺪ ﻋﻦ ﺳﺒﻴﻞ ﺍﻟﻠﻪ ﻣﻦ ﺃﻭ ﺃﻭﺑﺌﺔ ﺃﻭ ﺣﺮﻭﺏ ﺃﻭ ﻏﻴﺮ ﺫﻟﻚ ﻣﻦ ﺃﻧﻮﺍﻉ ﺍﻟﺒﻼﺀ ﻓﺄﺳﺒﺎﺑﻪ ﻣﺎ ﻛﺴﺒﻪ ﺍﻟﻌﺒﺎﺩ ﻣﻦ ﺃﻧﻮﺍﻉ ﺍﻟﻤﺨﺎﻟﻔﺎﺕ ﻟﺸﺮﻉ ﺍﻟﻠﻪ ﻛﻤﺎ ﻗﺎﻝ ﺗﻌﺎﻟﻰ : ) ﻭَﻣَﺎ ﺃَﺻَﺎﺑَﻜُﻢْ ﻣِﻦْ ﻣُﺼِﻴﺒَﺔٍ ﻓَﺒِﻤَﺎ ﻛَﺴَﺒَﺖْ ﺃَﻳْﺪِﻳﻜُﻢْ ﻭَﻳَﻌْﻔُﻮ ﻋَﻦْ ﻛَﺜِﻴﺮٍ ( ﻭﻗﺪ ﺑﻴﻦ ﺍﻟﻠﻪ ﺟﻞ ﻭﻋﻼ ﻣﺎ ﺣﺼﻞ ﻟﺒﻌﺾ ﺍﻷﻣﻢ ﺍﻟﺴﺎﺑﻘﺔ ﻣﻦ ﺍﻟﻌﺬﺍﺏ ﻭﺍﻟﻬﻼﻙ ﺑﺴﺒﺐ ﻣﺨﺎﻟﻔﺘﻬﻢ ﻷﻣﺮﻩ ﻟﻴﺘﻨﺒﻪ ﺍﻟﻌﺎﻗﻞ ﻭﻳﺄﺧﺬ ﻣﻦ ﺫﻟﻚ ﻋﺒﺮﺓ ﻭﻋﻈﺔ . ﻭﻻ ﻳﻜﻔﻲ ﺩﻋﻮﻯ ﺍﻷﺧﺬ ﻣﻦ ﺍﻟﺸﺮﻳﻌﺔ ﺍﻹﺳﻼﻣﻴﺔ ﺇﺫﺍ ﻭﺟﺪ ﻣﺎ ﻳﺨﺎﻟﻔﻬﺎ . ﻓﻘﺪ ﻋﺎﺏ ﺍﻟﻠﻪ ﺟﻞ ﻭﻋﻼ ﺫﻟﻚ ﻋﻠﻰ ﺍﻟﻴﻬﻮﺩ ﺣﻴﺚ ﻗﺎﻝ : ) ﺃَﻓَﺘُﺆْﻣِﻨُﻮﻥَ ﺑِﺒَﻌْﺾِ ﺍﻟْﻜِﺘَﺎﺏِ ﻭَﺗَﻜْﻔُﺮُﻭﻥَ ﺑِﺒَﻌْﺾٍ ﻓَﻤَﺎ ﺟَﺰَﺍﺀُ ﻣَﻦْ ﻳَﻔْﻌَﻞُ ﺫَﻟِﻚَ ﻣِﻨْﻜُﻢْ ﺇِﻻَّ ﺧِﺰْﻱٌ ﻓِﻲ ﺍﻟْﺤَﻴَﺎﺓِ ﺍﻟﺪُّﻧْﻴَﺎ ﻭَﻳَﻮْﻡَ ﺍﻟْﻘِﻴَﺎﻣَﺔِ ﻳُﺮَﺩُّﻭﻥَ ﺇِﻟَﻰ ﺃَﺷَﺪِّ ﺍﻟْﻌَﺬَﺍﺏِ ﻭَﻣَﺎ ﺍﻟﻠَّﻪُ ﺑِﻐَﺎﻓِﻞٍ ﻋَﻤَّﺎ ﺗَﻌْﻤَﻠُﻮﻥَ ( ﺍﻧﺘﻬﻰ . ﻓﻴﺠﺐ ﻋﻠﻰ ﻫﺆﻻﺀ ﺍﻟﺬﻳﻦ ﻳﻨﺎﺩﻭﻥ ﺑﺘﺤﺪﻳﺪ ﺳﻦ ﺍﻟﺰﻭﺍﺝ ﺃﻥ ﻳﺘﻘﻮﺍ ﺍﻟﻠﻪ ﻭﻻ ﻳﺨﺎﻟﻔﻮﺍ ﺷﺮﻋﻪ ﺃﻭ ﻳﺸﺮﻋﻮﺍ ﺷﻴﺌﺎ ﻟﻢ ﻳﺄﺫﻥ ﺑﻪ ﺍﻟﻠﻪ . ﻓﺎﻟﺤﻜﻢ ﻟﻠﻪ ﻋﺰ ﻭﺟﻞ ﻭﺍﻟﺘﺸﺮﻳﻊ ﺣﻖ ﻟﻪ ﺳﺒﺤﺎﻧﻪ ﻻ ﻳﺸﺎﺭﻛﻪ ﻓﻴﻪ ﻏﻴﺮﻩ . ﻭﻣﻦ ﺫﻟﻚ ﺃﺣﻜﺎﻡﺍﻟﺰﻭﺍﺝ ﻭﻗﺪ ﺣﺚ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﺑﻘﻮﻟﻪ : ) ﻭَﺃَﻧﻜِﺤُﻮﺍ ﺍﻷَﻳَﺎﻣَﻰ ﻣِﻨْﻜُﻢْ ﻭَﺍﻟﺼَّﺎﻟِﺤِﻴﻦَ ﻣِﻦْ ﻋِﺒَﺎﺩِﻛُﻢْ ﻭَﺇِﻣَﺎﺋِﻜُﻢْ ( ﻭﻗﺎﻝ ﺍﻟﻨﺒﻲ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ " : ﻳﺎ ﻣﻌﺸﺮ ﺍﻟﺸﺒﺎﺏ ﻣﻦ ﺍﺳﺘﻄﺎﻉ ﻣﻨﻜﻢ ﺍﻟﺒﺎﺀﺓ ﻓﻠﻴﺘﺰﻭﺝ ﻓﺈﻧﻪ ﺃﻏﺾ ﻟﻠﺒﺼﺮ ﻭﺃﺣﺼﻦ ﻟﻠﻔﺮﺝ " ﺍﻟﺤﺪﻳﺚ . ﻭﻓﻖ ﺍﻟﻠﻪ ﺍﻟﺠﻤﻴﻊ ﻟﻤﺎ ﻳﺤﺐ ﻭﻳﺮﺿﻰ ﻭﺟﻨﺐ ﺍﻟﺠﻤﻴﻊ ﻣﺨﺎﻟﻔﺔ ﺷﺮﻋﻪ ﻭﺩﻳﻨﻪ . ﻭﺻﻠﻰ ﺍﻟﻠﻪ ﻭﺳﻠﻢ ﻋﻠﻰ ﻧﺒﻴﻨﺎ ﻣﺤﻤﺪ ﻭﺁﻟﻪ ﻭﺻﺤﺒﻪ . ﻛﺘﺒﻪ : ﺻﺎﻟﺢ ﺑﻦ ﻓﻮﺯﺍﻥ
