📢 DEMOCRACY IN JEOPARDY: President Assents To State-Sanctioned Homophobia 📢

Namibia has enacted the Marriage Act, 2024 (Act No. 14 of 2024), defining marriage exclusively as a union between a man and a woman. This new law prohibits the recognition of same-sex marriages, even those legally conducted abroad, reversing the 2023 Supreme Court ruling that recognized such unions for residency and related purposes. The Act also introduces stricter regulations for both heterosexual & same-sex couples. While also denying trans persons the right to found a family.

The legislation has raised concerns about its discriminatory provisions. With the exclusion of same-sex marriages, which contradicts constitutional guarantees of equality and dignity, it weaponizes LGBTQI+ rights at the peril of our democratic backsliding. Activists warn that this is not just a step back for LGBTQ+ rights but a blow to Namibia’s commitment to upholding human rights and are inviting legal challenges to defend our democracy for all.

This law impacts all Namibians, from stricter marriage age requirements to mandatory public notification of intended unions. Its effects extend beyond same-sex couples, complicating cross-national marriages and limiting personal freedoms.

Equal Namibia Activists calls for strategic litigation support and Namibians whose rights are violated by this unconstitutional law to join us in our fight.
