France just tried to force Catholic priests to break the seal of confession — and the Church fought back and won.

The French National Assembly unanimously approved a bill aimed at strengthening the protection of minors against violence in school and extracurricular settings. However, the final text excluded two measures that had raised significant concern within the Catholic Church: the abolition of the seal of confession, and the tightening of controls over state-funded Catholic education.  The original bill had included language explicitly stating that no “seal of confession” could override a priest’s legal obligation to report abuse of a child to authorities — a provision that would have effectively made confession a tool of state surveillance. The debate emerged in the wake of the Bétharram abuse scandal, which prompted hundreds of allegations linked to a Catholic school run by the Priests of the Sacred Heart of Bétharram.  After fierce pushback from the French Episcopal Conference and Catholic legal scholars, the French Parliament pulled the amendment that would have forced priests to break the seal of confession, following a vocal backlash from Catholics and conservative parties. 

The seal of confession is one of the most ancient disciplines in the Catholic Church. A priest who violates it faces automatic excommunication under canon law. For nearly 2,000 years, what is spoken in the confessional has remained between the penitent, the priest, and God. France just learned that some things cannot be legislated away.

The state does not have jurisdiction over the soul. France remembered that this week.

Hija okkażjoni ta’ ferħ bħala Insara li din oħtna qed tagħmel dan il-pass kbir u sabiħ. Ejjew nakkumpanjawha bit-talb tagħna.
