The Italian Constitutional Court has issued an important new decision on the recent reform of citizenship by descent.

The Judgment No. 63/2026 of the Italian Constitutional Court is the first constitutional ruling addressing the changes introduced in 2025, which limited the recognition of Italian citizenship for descendants born abroad.

While it would be premature to draw definitive conclusions, the decision introduces important elements that will shape the next phase of legal interpretation and litigation.

The Constitutional Court will publish soon its decision.

On 12 March 2026, the Court released a preliminary announcement following the hearing on Decree-Law 36/2025, the law introducing new restrictions on Italian citizenship by descent (jure sanguinis).

At this stage, the Court has only communicated a summary of its position.
The full judgment has not yet been published, and that document will clarify the legal reasoning and the exact scope of the decision.

This means that many of the details that could affect citizenship cases are still being defined.

This is not the end of the road — this is a crucial moment of transition in Italian citizenship law.

The Court is expected to give directions on how the new limits apply to descendants and how courts will interpret the transitional rules.

In the coming months, further developments are expected before the Constitutional Court — including new hearings and guidance - as well as before the other highest Court in Italy, the Supreme Court in United Sessions, which will help shape the future of Italian Citizenship by descent.
