Considerazione giuridica e spunto di riflessione accademica: in occasione del secondo anniversario della poco conosciuta ma importantissima sentenza della Corte di Giustizia dell'Unione europea c.d. sentenza ISU del 21/12/2023 rivolta alla International Skating Union, EurEthICS Training Academy ritiene opportuno riportare all'attenzione dei propri associati i principi della sentenza che ribadiscono i diritti degli atleti a partecipare a manifestazioni sportive fuori dai circuiti riconosciuti dal CIO (la sentenza è infatti applicabile all'ISU come a tutte le altre federazioni CIO). Infatti le norme che consentono di sottoporre le competizioni internazionali di pattinaggio di velocità su ghiaccio (ma non solo di questo sport NDA) alla sua (dell'ISU) approvazione e di imporre sanzioni severe agli atleti che partecipino a competizioni non autorizzate, sono state ritenute dalla Corte illegittime in quanto non sono delimitate da alcuna garanzia che ne assicuri il carattere trasparente, obiettivo, non discriminatorio e proporzionato. Considerando l'importanza di questa giurisprudenza, EurEthICS vuole stimolare presso i propri associati - siano essi individui o organizzazioni - la promozione dei propri diritti, la sensibilità e il rispetto degli stessi e la libertà di partecipare a manifestazioni organizzate da enti o federazioni pubbliche, private o no-profit che operino secondo i principi di fair play e integrità degli sportivi. EurEthiCS promuoverà un primo passo che potrà essere intrapreso dalle Federazioni, Enti, Organizzazioni Nazionali o Internazionali: un protocollo per operare attraverso il mutuo riconoscimento e la promozione del concetto di "legittimità reciproca"... with Fair Play .
