Article 17 of the Indian Constitution legally abolishes "untouchability" in all its forms, forbidding its practice and making the enforcement of any disability arising out of it a punishable offense. It is a core Fundamental Right under the Right to Equality.

Article 16 of the Indian Constitution guarantees equality of opportunity in matters of public employment, prohibiting discrimination based on religion, race, caste, s*x, descent, place of birth, or residence. It mandates fair treatment in government jobs while permitting affirmative action for backward classes.

Key provisions of Article 16 include:
16(1) & 16(2): Equality of opportunity for all citizens in state-related employment, with no discrimination on grounds of religion, race, caste, s*x, descent, place of birth, or residence.
16(3): Parliament can make laws requiring residency within a state for specific jobs.
16(4): The state can reserve jobs for backward classes not adequately represented in government services.
16(4A) & 16(4B): Allows for reservation in promotions for SCs/STs and enables carrying forward unfilled reserved vacancies.
16(5): Allows special provisions in religious institutions for officials to belong to that specific religion.
16(6): Added by the 103rd Amendment (2019), it provides up to 10% reservation for Economically Weaker Sections (EWS).

Key Interpretations:
1. Indra Sawhney Case (1992): Established that total reservations should generally not exceed 50%, and introduced the concept of the "creamy layer" exclusion for OBCs.
2. Janhit Abhiyan Case (2022): Upheld the 10% EWS reservation, affirming it does not violate the basic structure of the Constitution, even if it exceeds the 50% limit.
