THIS PIECE IS ABOUT Dr. QASIM FAKTOO, "I am victim of the deep Indian state. I expressed my unwillingness to plunge in to the bandwagon of sham political process in year 2000 and was penalized. Indian Intelligence Agencies blamed me of conspiring to kill a Human Rights leader H N Wanchoo. How could have I schemed to liquidate a friend of the freedom movement.
When H N Wanchoo was killed on December 5,1992, I was outside the state. I returned on 8th and condemned his killing in unequivocal terms, spoke lot about his concern for deteriorating humanitarian situation in Kashmir. I had never imagined that I would ever be charged for his killing. All of a sudden, around two months after the killing of Wanchoo, I was arrested and lodged infamous Papa-2 interrogation centre. The CBI, implicating me in Wanchoo’s killing, produced a challan against me in the TADA court. It was a case, sans witness or evidence. I was tortured severely and forced to sign some papers, which were later presented as my con­fession statements before the TADA court.
The trial ended in 1999 and I was honourably acquitted on the assertion that the confession state­ment was devoid of proper technicali­ties. But the CBI had something else in mind. They filed an appeal in the Supreme Court against my exonera­tion after three months. I was again put under detention, this time in the Amphalla jail. It was year 2000 when I was pursuing my Ph.D at Kashmir University.
I was shifted to torture centre at Talab Tiloo Jammu. Indian intelli­gence agencies approached me. They possessed a copy of my latest publica­tion, Maslai Kashmir ki Sharaie Hai-syat (Kashmir imbroglio in the light of Musiim law).
I was offered a barter in plain terms: join the apparatus of electoral politics, the case will be withdrawn. They (IB men) even offered me the education portfolio. “Since you are a highly educated man, the ministry of education befits you” they told me. They also said that they had already reached an understanding with four All Parties Hurriyat Conference leaders. “The dispute is on the quota of seats. They (Hurriyat) are demanding 35 seats and we are offering 15″, they said. Two amongst these leaders (who are alive) did not contest elections. One was gunned down by unidentified militants. Only one of them joined the elec­tion race to forfeit his security deposit. My interaction with them con­tinued for nearly 10 days. They found me impersonal for the bait and left with a warning YOU WILL ROT IN THE JAIL FOR LIFE.
How ridiculous it looks. Not only the chief ministers are selected by the Indian agencies but even portfolios and assembly seats are also decided by them in Kashmir.
From here, I was shifted to Kotebalwal jail. In August 2002, the JKLF chairman Mohamed Yasin Malik sent me a message he had overheard somewhere that I will be imprisoned for life for failing the intelligence sleuths.
Another senior pro freedom advocate, Salim Zargar also told me that agencies have decided to silence me by putting me in jail for life. This speaks of the system of justice preva­lent in Kashmir.
In 2003 happened exactly what I had been threatened with. I was awarded a life imprisonment for a crime which I never committed. TADA court judgment was set aside and my confession under coercion was made justification for the sentence. It was a case of a blanket political hostility. I did not fall in line and was condemned."
