*Subject: Concern regarding attendance criteria and its impact on law students at the University of Kashmir*

A number of complaints have been received from the School of Law, University of Kashmir, where some first-year students have been barred from appearing in examinations. Other semester students have also been warned of similar consequences if they fail to fulfill the attendance criteria. As a result, students of the institution and its affiliated colleges are suffering from mental distress, largely due to the approach of the Head of the Department (HOD) of the Law Department.
Recently, the Delhi High Court, in the case 'Courts on its Own Motion in Re Su***de Committed by Sushant Rohilla, Law Student of I.P. University,' held that a law student cannot be barred from examination due to a lack of minimum attendance. Despite this ruling, the Law Department appears to have violated the judgment of the Hon'ble Delhi High Court.
In light of the above, we humbly request that the Chancellor and Vice-Chancellor look into this matter seriously to protect the future of the law students and prevent any recurrence of incidents similar to that of Sushant Rohilla in the future.

*No Summons to Advocates Except Under Section 132 of the Bharatiya Sakshya Adhiniyam — Prior Approval of Superior Officer Made Mandatory: Supreme Court Issues Landmark Directions*
In a significant judgment safeguarding the independence of the Bar, the Supreme Court has ruled that **investigating agencies cannot summon practising advocates** for interrogation or disclosure of client communications *except under the limited exceptions specified in Section 132 of the Bharatiya Sakshya Adhiniyam, 2023 (BSA)*.
The Bench comprising *Justice B.R. Gavai (CJI), Justice K. Vinod Chandran and Justice N.V. Anjaria* issued a series of mandatory directions in a *Suo Motu Writ Petition (Criminal)* concerning the recent trend of advocates being summoned by agencies such as the Enforcement Directorate and CBI.
The Court has held that:
1. *No summons shall be issued to practising advocates* representing any accused or client, *unless* the case falls strictly within the exceptions under Section 132 BSA (communications made for illegal purpose or disclosure of facts constituting crime/fraud).
2. Even in such exceptional cases, *prior written approval of a superior officer not below the rank of Superintendent of Police* is *mandatory* before issuing summons, with recorded reasons.
3. Any summons issued contrary to these directions shall be *liable to judicial review* and may be challenged by the advocate or client concerned.
4. The Court further directed that *digital devices or documents in possession of an advocate* cannot be seized or opened except under judicial supervision, ensuring confidentiality of other clients.
The judgment reinforces the sanctity of *advocate–client privilege* and aims to protect lawyers from harassment and intimidation in the course of professional duties.

The University of Kashmir deeply mourns the passing of Prof. Abdul Wahid Qureshi, former Vice Chancellor of the University, who passed away at SKIMS in Soura following a cardiac arrest. Prof. Qureshi was a towering figure in academia, known for his visionary leadership and invaluable contributions to the educational development of Jammu and Kashmir.
Expressing her heartfelt condolences, Vice Chancellor Prof. Nilofer Khan said, "The demise of Prof. Abdul Wahid Qureshi is an irreparable loss to the academic community. His unwavering dedication to education and his exemplary leadership will remain a source of inspiration for generations to come."
A condolence meeting to pay homage to the departed soul will be held at 11:00 AM in the University of Kashmir. The meeting will be presided over by the Hon'ble Vice Chancellor, Prof. Nilofer Khan.
