General Data Protection Regulation(GDPR):
GDPR is General Data Protection Regulation European Union’s new data protection law. It replaces the Data Protection Directive (Directive”), which has been in effect since 1995. GDPR takes effect on May 25, 2018 & actually became law in April 2016.
GDPR is a new set of rules designed to give EU citizens more control over their personal data & also new bar globally for privacy rights, security, and compliance.
Under the terms of GDPR, not only will organisations have to ensure that personal data is gathered legally and under strict conditions, but those who collect and manage it will be obliged to protect it from misuse and exploitation.
GDPR applies to any organisation operating within the EU, as well as any organisations outside of the EU which offer goods or services to customers or businesses in the EU.
There are two different types of data-handlers the legislation applies to: 'processors' and 'controllers'.
The definitions of each are laid out in Article 4 of GDPR.
“Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.
“Processor” means a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller.
“Personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
“Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
