आदरणीया मैडम जज साहिबा,

आप शायद क़िस्मत वाली थी कि जब आप बचपन को छोड़ टीनएज़ में क़दम रख रहीं थी और आपके मन के साथ आपका शरीर भी बदल रहा था. जब ब्रेस्ट आने लगे थे और आप अपने ही शरीर में हो रहे बदलाव को अपना भी नहीं पा रही होंगी, तब कलेजे पर उग़ रहे मांस के छोटे टुकड़ों को कपड़े के ऊपर से दबा कर या नोच कर नहीं भागा. आप शायद कभी किसी वैसी जगह से नहीं गुज़री जहां ज़बरदस्ती से किसी ने पीछे से अपने पेनिस को आपके बदन में सटाने की कोशिश नहीं की या फिर आपके पजामे को खोल कर आपके साथ कुछ ग़लत नहीं किया.

लेकिन इसका ये मतलब बिल्कुल नहीं हुआ कि जिन बच्चियों के साथ ये हुआ होगा उन्हें कोई ट्रॉमा महसूस नहीं हुआ होगा. आपको क्या पता भीड़ में चलते हुए जब कोई ज़बरदस्ती से आपकी छाती को मसल कर निकल जाए तो कैसा लगता है. घर आने बाद पत्थर से रगड़ कर खून निकल आने तक उसे धोती हैं लड़कियाँ कि वो घृणा से भरी छुअन धूल जाए मगर वो टच नहीं धूल पाता. जानती हैं आप लड़कियाँ घृणा करने लगती हैं अपने बदन से. वो कभी भी नॉर्मल नहीं हो पाती हैं अपने ही शरीर को ले कर और आपने तो मुंबई हाई-कोर्ट में बैठ कर फ़ैसला सुना दिया कि,

“The allegation was not serious enough for the greater punishment prescribed under the law.”

क्योंकि आपकी नज़र में नागपुर के उस 39 साल के मर्द की गलती एकदम छोटी लगी जिसने 12 साल की बच्ची को अपने घर अमरूद देने के लालच से बुलाया, जहां उसने ज़बरदस्ती उसकी छातियों को दबाया और उसके सलवार के नाड़ा खोलने की कोशिश की. आपको ये नॉर्मल लगा और आपने उसे सिर्फ़ 3 साल की सज़ा सुनाई. आपके लिए तालियाँ बजती रहनी चाहिए. आपने साबित किया है मैडम की सिर्फ़ पुरुष ही नहीं बल्कि स्त्रियाँ भी जेंडर-सेंसिटिव नहीं होती हैं. स्त्रियाँ भी मिसोजेनिस्ट होती हैं और Misogynistic सोच रखती हैं.

मैडम आपने कहा कि,

“since the convict groped the prosecutrix over her clothes, this indirect contact would not constitute sexual assault.”

तो आपके हिसाब से कपड़े के ऊपर से अगर कोई छातियों को दबा दे, मसल दे, कपड़े के ऊपर से अपने पेनिस को लड़की के शरीर के किसी हिस्से में सटाने की कोशिश करे तब वो सेक्शूअल असॉल्ट नहीं होगा.

मैडम जज साहिबा, आपके हिसाब से फिर लड़की की वज़ाईना जब तक छड़ नहीं घुसे, जब तक जलती मोमबत्ती अंदर नहीं डाल दिया जाए, जब तक ब्रेस्ट को काट कर हटा नहीं दिया जाए तब तक उसे Sexual assault नहीं माना जाएगा.

बहुत शुक्रिया आपका. आपने पुरुषों को साइलेंट आमंत्रण दिया है अपने इस फ़ैसले से कि आओ और लड़कियों और बच्चियों को मनमर्ज़ी से कपड़ों के ऊपर छुएँ और दबोचें. आपके लिए अब सब आसान होने वाला है. अपराधी मानसिकता के पुरुषों के लिए आप जैसी जज किसी वरदान से कम थोड़े हैं. तारीख़ आपके इस फ़ैसले को याद रखेगी.
