When courtroom logic speaks louder than emotion ⚖️

In a viral High Court of Karnataka hearing, the Bench questioned how a man with a take-home salary of ₹12,000 could be ordered to pay ₹10,000 as maintenance for the child, asking a simple but powerful question, How will he live?

Maintenance law is meant to ensure fairness, dignity, and support, not to create an impossible burden beyond earning capacity.

True justice balances rights with reality.

📌 Mohd. Arif Ahmad Jahagir Khan v. State of Madhya Pradesh (2026)

🔍 Facts of the Case:
A Muslim woman filed an FIR against her husband alleging cruelty, assault, and that he had contracted a second marriage during the subsistence of their first marriage (solemnized in 2002). The second marriage took place in 2022, leading to charges under Section 494 IPC (Bigamy), along with Section 498A and other provisions.

⚖️ Legal Issue:
Whether a second marriage contracted by a Muslim man during the lifetime of his first wife amounts to the offence of bigamy under Section 494 IPC?

⚖️ Judgment:
The Madhya Pradesh High Court held that:
👉 A second marriage by a Muslim man is NOT void under Muslim Personal Law.
👉 Since Section 494 IPC applies only when the second marriage is void, the offence of bigamy is not attracted.

Law vs. Morality: A Significant Ruling by Allahabad HC 🏛️

​Can parents-in-law claim maintenance from their daughter-in-law? The answer, according to the High Court, is No. While there may be a moral duty, the law under Section 144 of BNSS only protects:

✅ Wives
✅ Children
✅ Biological Parents

​The Court refused to expand the law’s scope beyond what the Parliament has written. 📜
