What is Force Majeure?
A common clause in a contract that essentially frees the parties to a contract from the obligation to fulfill their duties under the contract when an extraordinary event or scenario beyond the control of the parties occur. Example : War, riots, famines, strikes, a major crime, epidemic or 'An act of God' - say, flood, earthquake, volcanic eruption and so on. Important to note : Most 'force majeure' clauses do not excuse a party's non-performance entirely, but only suspend it for the duration of the 'force majeure'. The current situation of Covid-19 is considered as an epidemic and hence have invoked 'Force Majeure' for many contracts.
