103वें संविधान संशोधन के जरिए सवर्ण गरीबों के लिए 10% आरक्षण का प्रावधान किया गया। इसके मुद्दे पर 30 से ज्यादा याचिकाओं पर सुप्रीम कोर्ट में सुनवाई चल रही है।

याचिकाओं में संविधान के अनुच्छेद 15 और 16 में संशोधन किए जाने को चुनौती दी गई है। इन याचिकाओं में कहा गया है कि आर्थिक आधार पर आरक्षण असंवैधानिक है और सरकार ने बिना जरूरी आंकड़े जुटाए EWS आरक्षण का कानून बना दिया।

जनवरी 2019 में 103वां संविधान संशोधन के जरिए आर्थिक रूप से कमज़ोर सामान्य वर्ग के लोगों को नौकरी और शिक्षा में 10 % आरक्षण की व्यवस्था की गई थी।

5 अगस्त 2019 को सुप्रीम कोर्ट ने सामान्य वर्ग के गरीबों को 10 फीसदी आरक्षण के खिलाफ दायर याचिकाओं को संविधान पीठ को सौंपा था।
