ای ده عقل خاوندانو تاسو ده دې آيات او عکس په اړه خپل فکر کولای شئ چې عصري علم مباح که فرض؟

عصري علوم فرض که مباح؟

ای کاش! زموږ‎ سترو علمای کرامو، شیوخو او استادانو د خالد الحنفي صاب د خبرو تصحیح کړ‎ې وہ تر څو زما پشان د کم علم او ټیټې سویې مبتدي طالب په دې اړ‎ہ څه لیکلو ته نه و اړ‎ شوی!
که موږ‎ د علم کلمې ته ځیر شو نو و به وینو چې د قرآن کریم د نزول په پیل کې الله عزوجل د انسان د خلق د علم خبرہ کوي. الله عزوجل خپل اقدس ذات انسان ته د خپل تخلیق د علم له لیارې ور پیژني، الله عزوجل وایي:
اقْرَأْ بِاسْمِ رَبِّكَ الَّذِي خَلَقَ (1) خَلَقَ الْإِنْسَانَ مِنْ عَلَقٍ (2) اقْرَأْ وَرَبُّكَ الْأَكْرَمُ (3) الَّذِي عَلَّمَ بِالْقَلَمِ…..
بیا فرمایي: عَلَّمَ الْإِنْسَانَ مَا لَمْ يَعْلَمْ؛ مانا داچې انسان په ھیڅ نه پوھید او ټول علوم ورته الله عزوجل ورکړ‎ل.
لومړ‎ی الله عزوجل خپل ذات ورته داسې ورپیژني چې ھر څه الله تعالی پیدا کړ‎ي: “اقْرَأْ بِاسْمِ رَبِّكَ الَّذِي خَلَقْ “
او بیا د عمومي علم خبرہ کوي .
د مباح او غیر مباح خبرہ پکې نشته، ځکه ټول علوم الله عزوجل انسان ته ورکړ‎ي.

د آدم علیه السلام فضیلت پر ملایکو ھم د علم له لیارې شوی، ھلته ھم علم په مجموع کې یاد شوی.
الله عزوجل وفرمایي: وَعَلَّمَ ءَادَمَ ٱلْأَسْمَآءَ كُلَّهَا…..
یانې ما انسان ته د ھر څه علم ورکړ‎، دلتة ھم د کلِّھا کلمة عمومیت راولي چې ټول علوم پکې شامل دي؛ دیني او دنیوي۔۔۔۔۔
دا خو بیا وروسته علم پر دیني او دنیوي قسمونو وویشل شو؛ ھغه علم چې انسان پرې مسلمان/مومن کیږ‎ي او خپل روزمرہ دیني واجبات پر اداء کوي، فرض عین او نور یې کفایي فرض دي! دلته ھم د مباح او غیر مباح خبرہ نشته. د علم زدہ کړ‎ہ له واجباتو څخه دہ چې یوہ برخه یې فرض عین او بله یې د ټولنې د احتیاج او اړ‎تیا له مخې کله کفایي او کله ھغه ھم فرض عین وي!
د ستر امام شافعي رحمه الله او ھمداراز زموږ‎ د جمھورو علماو په نزد د ھغه دنیوي علم زدہ کړ‎ہ فرض عین دہ چې د مسلمانانو ټولنه ورته اړ‎تیا ولري!
که شیخ خالد صیب کله په تورخم کې له ھغو مریضانو سرہ په کتار کې ودریږ‎ي چې پاکستان ته د علاج لپارہ ځي نو زہ متیقن یم چې د طب علم د زدہ کړ‎ې فرضیت ته به قایل شي!
اوس که پورتني بحث ته ځیر شو نو پوہ به شو چې د علم مطلقه زدہ کړ‎ہ فرض دہ، چې بیا وروسته د دیني او دنیایي اړ‎تیاو له مخې پر فرض عین او کفایي ویشل شوې دہ؛
د مباح خبرہ اصلاً مطرح نه دہ!!
د علم په فرضیت کې به تر دې بل پورته دلیل څه وي چې پیغمبر علیه السلام ورته د “فریضة” کلمة کارولې
( طَلَبُ الْعِلْمِ فَرِيضَةٌ عَلَى كُلِّ مُسْلِمٍ ).

مباح څه ته وایي؟
زموږ‎ علمای کرام مباح ھغه عمل ته وایي چې پر کولو یې ثواب او پر نه کولو یې عذاب نه وي. فقھاء ټول شیان پر پنځو کټه گوریو ویشي چې دوہ یې روا ( فرض او مستحب ) او دوہ یې ناروا ( حرام او مکروہ ) دي او د دې شیانو په منځ کې مباح موقعیت لري.
زموږ‎ په فقه کې یوہ سترہ قاعدہ ھم د مباح په اړ‎ہ دہ:
الأصل في الأشياء الإباحة مانا دا چې ھر څه مباح دي تر څو یې تحریم نه وي ثابت شوی، د ھغه څه چې فرضیت، استحباب، تحریم او کراھیت ثابت وي تر دې کټه گورۍ لاندې نه راځي؛ بیلگې یې ډیرې زیاتې دي خو زہ به دلته قراني بیلگه راوړ‎م.
الله عزوجل فرمایي: وَأَحَلَّ ٱللَّهُ ٱلۡبَيۡعَ وَحَرَّمَ ٱلرِّبَوٰاْۚ……
دلته بیعه حلاله یا مباح گڼل شوې په دې مانا چې اخیستل، خرڅول، تجارت او نور ټول مباح اعمال دي چې پر نه کولو یې سړ‎ی نه گناھگاریږ‎ي!
که د علم زدہ کړ‎ہ ھم مباح وگڼل شي نو د علم پر نه حصول باید سړ‎ی گناھکار نه شي! او که د شیخ خالد صیب خبرہ سمه وگڼو نو بیا نه یواځې فرایض له منځه ځي بلکې ورسرہ زموږ‎ ټول ھغه احکام چې د معاملاتو پر فقھې پورې اړ‎ہ لري ھم له منځه ځي!
ھمدا راز په قران کریم کې څه د پاسه پنځه سوہ آیات الأحکام او نور ټول ھغه مبارک احادیث چې د عباداتو او فضایلو په اړ‎ہ نه دي ھم خپل اھمیت او ضرورت له لاسه ورکوي، استغفر الله ثم استغفر الله!

بله مھمه خبرہ دا وہ چې شیخ خالد د مباح او امیر د حکم په اړ‎ہ وکړ‎ہ؛ ھغه وایي چې کله د مباح او د امیر تر منځ تعارض راشي، د امیر حکم منل واجب دي!
دا خبرہ پخپل ذات کې تر یوہ حدہ سمه دہ خو د تعلیم په اړ‎ہ ځکه سمه نه دہ چې تعلیم زموږ‎ د ټولو علمای کرامو، مجتھدینو او سلف الصالح په نزد فرض دی نه مباح!
ھمداراز د امیر لخوا مباحاتو ته حد ټاکل یا تصرف پکې کول ھم په ټوله کې سم نه دی! ځکه چې:

۱- موږ‎ په اسلامي فقه کې دې ته یوہ سترہ قاعدہ لرو چې وایي: تصرف الإمام علی الرعیة منوط بالمصلحة یانې د مسلمانانو امیر په مباحاتو کې د مصلحت له مخې تصرف کولای شي.
بیا مو علمای کرام مصلحت په دوہ کټه گوریو ویشي، خاص او عام. که چرته د امام فعل د عامو امورو په اړ‎ہ وي نو امر یې باید شرعاً نافذ نه شي. په نص ثابت مباحات مقید کول زموږ‎ د جمھورو علماو په نزد اصلاً جواز نه لري!

۲- دا مصلحت باید ټولنې ته د نفعې رسولو او یا د ضرر د دفعې لپارہ وي، یانې د ټولنې یو ستر مصلحت ورپورې تړ‎لی وي؛ د تعلیم ( دیني او دنیوي )مخه نیول نه د ټولنې په نفعه دہ او نه پکې د ضرر دفع موجودہ دہ.

۳- که امام المسلمین په خاصو مصالحو کې ھم په آزاد مټ تصرف ته پریښودل شي نو ډیر کم وخت پکار وي چې د صالح امام څخه یو مطلق العنان دیکتاتور جوړ‎ شي، چې بیا دا ھر څه په ټولنه کې د شرعي نظام اساسات متضررہ کوي.

۴- که زموږ‎ علمای کرام، تکړ‎ہ لیکوالان او نور اھل خِبرہ خلک په داسې مسائلو کې د مضر احتیاط یا خپل موقف ساتلو لپارہ سکوت اختیاروي نو په حقیقت کې د دې مبارک حدیث “ الدین النصیحة” اصل تر پښو لاندې کوي!
چې ضرر یې بیا تر ټولو زیات ام ارت او ټولنې ته رسیږ‎ي!
راځئ! اشخاص په امارت وپیژنو، د اشتباھاتو د اصلاح کوښښ یې وکړ‎و نه دا چې اما رت په اشخاصو وپیژنو!

ھیله دہ ملگري راڅخه خفه نه شي!

Asking a question well half knowledge.

Interpretation: To remove one's doubt by asking a question in a scientific problem is half knowledge, because of this question, one's doubt will be further removed, and he will gain complete knowledge.
