⚖️ FEARING ARREST? WHAT IS ANTICIPATORY BAIL?
Anticipatory Bail is a form of pre-arrest legal protection that may be sought when a person has reason to believe that they may be arrested for a non-bailable offence, subject to the applicable law and facts of the case.
📌 IMPORTANT TO KNOW
• Anticipatory Bail is sought before arrest
• It is not granted automatically merely because arrest is feared
• The Court considers the allegations, nature and gravity of the offence, circumstances of the case and other relevant factors
• The Court may impose appropriate conditions while granting protection
• Grant or refusal depends upon the facts and applicable law in each case
⚠️ ANTICIPATORY BAIL ≠ ACQUITTAL
Grant of anticipatory bail does not decide whether the accused is guilty or innocent. It concerns protection from arrest subject to the Court's order.
