๐Ÿ“˜ ANTI-DEFECTION LAW (TENTH SCHEDULE) โ€“ QUICK REVISION NOTES ๐Ÿ‡ฎ๐Ÿ‡ณ

The Anti-Defection Law was added to the Constitution through the 52nd Constitutional Amendment Act, 1985 to curb political defections and ensure stability in governments. It is contained in the Tenth Schedule.

๐Ÿ”น Grounds for Disqualification:
โ€ข Voluntarily giving up membership of a political party
โ€ข Voting/abstaining against party whip without permission (not condoned within 15 days)

๐Ÿ”น Decision Authority:
โ€ข Decided by the Speaker/Chairman of the House
โ€ข Subject to judicial review (as held in Kihoto Hollohan v. Zachillhu, 1992)

๐Ÿ”น Important Exception โ€“ MERGER (Para 4):
โ€ข No disqualification if at least 2/3rd members of a legislature party agree to merge with another party
โ€ข The merger must be voluntary and collective
โ€ข Members accepting the merger are protected from disqualification

โ€ข The earlier provision of split (1/3rd members) was removed by the 91st Constitutional Amendment Act, 2003
