Update on "Service of E-summons" in civil suits:
The Bombay High Court in "SBI Cards and Payment Services v. Rohidas Jadhav" and the Delhi High Court in "Tata Sons Ltd v. John Doeset" recognised service of summons through instant messaging platforms like WhatsApp. Further, the Punjab & Haryana High Court in "Amar Singh v. Sanjeev Kumar" issued directions to revenue courts in the State (i.e., Haryana) for service of summons, notices and pleadings through email, and even through instant messaging services like WhatsApp, Signal etc. The Court held that parties and their advocates should provide email IDs, along with their contact details on which they are registered with instant messaging service, for service of summons, pleadings etc.
These rulings are squarely applicable in cases of GST as well.

सिविल मुकदमों में "ई-समन की सेवा" पर अपडेट:
बॉम्बे हाईकोर्ट ने 'एसबीआई कार्ड्स एंड पेमेंट सर्विसेज बनाम रोहिदास जाधव' मामले में और दिल्ली हाईकोर्ट ने 'टाटा संस लिमिटेड बनाम जॉन डोसेट' मामले में व्हाट्सएप जैसे इंस्टेंट मैसेजिंग प्लेटफॉर्म के माध्यम से समन की सेवा को मान्यता दी थी. इसके अलावा, पंजाब और हरियाणा उच्च न्यायालय ने "अमर सिंह बनाम संजीव कुमार" मामले में राज्य (यानी, हरियाणा) में राजस्व अदालतों को ईमेल के माध्यम से और यहां तक कि व्हाट्सएप, सिग्नल आदि जैसी त्वरित संदेश सेवाओं के माध्यम से समन, नोटिस और दलीलें देने के निर्देश जारी किए। अदालत ने कहा कि पक्षकारों और उनके वकीलों को समन, निवेदन आदि की सेवा के लिए अपने संपर्क विवरण के साथ ईमेल आईडी प्रदान करनी चाहिए, जिस पर वे त्वरित संदेश सेवा के साथ पंजीकृत हैं।
ये फैसले जीएसटी के मामलों में भी पूरी तरह से लागू होते हैं।
