On January 14, 2026, the Delhi High Court directed the Delhi government to ensure that Parent-Teacher Associations (PTAs) are properly constituted and functional in all private schools across the national capital.
The court's directives and context include the following:
Mandatory Formation: A division bench of Chief Justice D.K. Upadhyaya and Justice Tejas Karia ordered the Directorate of Education (DoE) to take immediate steps to ensure that every private unaided school has a functioning PTA.
Affidavit Requirement: The government must file an affidavit within four weeks detailing the specific actions taken to enforce these statutory requirements.
Key Legal Context:
- Statutory Requirement: PTAs are mandated under the Delhi School Education Act, 1973 to foster transparency and cooperation between parents and school management.
- Fee Regulation: The court highlighted that PTAs are crucial for parents to challenge arbitrary fee hikes, especially under the Delhi School Education (Transparency in Fixation and Regulation of Fees) Act, 2025.
Non-Compliance: The order was issued following a Public Interest Litigation (PIL) by the NGO Justice For All, which alleged that at least 170 schools were non-compliant or had formed "sham" bodies with hand-picked members.
Next Hearing: The court has scheduled the next hearing for April 29, 2026, to review the progress of these implementations.
For more information on school regulations, you can visit the Directorate of Education (DoE) website.
