Applicability of E-way Bill

E-way bill will be mandatory from 1st February 2018 onward. and it will be applicable, all over India including Jammu & Kashmir, on the movement of goods (taxable goods) having value (invoice Value) of exceeding 50 thousand, from one state to another. it shall be raised by customers as well as by transporter itself.

Applicability of GST on Transport of Goods via Road
The service of transpiration of goods (taxable goods) by road continue to be exempt under the GST regime. GST is applicable only on goods transport agency (GTA) and Courier agency.

GTA means any person who provides service in relation to transport of goods by road and issues consignment note, by whatever name called. therefore consignment note is essential condition to be considered as a GTA.

GTA does not have to register under GST if he is exclusively transporting goods where the total tax is required to be paid by the service recipient under reverse charge basis (even if the turnover exceeds three sold limit)

Input Tax Credit

If GTA pays GST

12% GST with ITC

OR

5% GST with no ITC

however, the GTA has to opt at the beginning of Financial year.

As per the amendment made in constitution, following products are out of GST (Goods and Service Tax) Net.

1. Alcohol for Human Consumption
2. Petroleum Products (such as petroleum crude, motor spirit (petrol), high speed diesel, natural gas and aviation turbine fuel etc)
3. Electricity

However, the taxes for these products will be charged as per the structure before introduction of GST.
