🚨 MYTH vs REALITY: Bailable & Non-Bailable Offences
❌ MYTH: A non-bailable offence means “NO BAIL”.
✅ REALITY: “Non-bailable” does NOT mean that bail can never be granted. It means that bail is not available as a matter of right and the competent court considers the facts and circumstances of the case before deciding whether bail should be granted.
⚖️ In a bailable offence, bail is generally available as a matter of right, subject to the applicable law and procedure.
In a non-bailable offence, factors such as the seriousness and nature of the offence, the circumstances of the case, the possibility of influencing witnesses, and other relevant factors may be considered while deciding bail.
👉 So, remember: Non-bailable ≠ No Bail.
