The Legal Prudence

Besides allowing the intervention applications, the Court accepted a suggestion to implead the Animal Welfare Board of India as a respondent and issued notice to it. It was further conveyed that in due course of time, the bench would issue directions to regulate the feeding of dogs in premises of government buildings.

Section 132 of the Bharatiya Sakshya Adhiniyam (BSA), 2023 protects confidential communications between an advocate and their client, preventing disclosure without the client’s express consent.

The Hon’ble Bench said in its judgement that Section 132 of the BSA “is a privilege conferred on the client obliging the advocate not to disclose any professional communications made in confidence”.
The bench also termed the conduct of the High Court as an ‘abdication of the inherent powers’ conferred upon it. The reason to turn down the advocate given by the High Court was also held to be unreasonable.

In exercise of the powers conferred by the Constitution of India, the President has appointed Shri Justice Surya Kant, Judge of the Supreme Court of India as the Chief Justice of India with effect from 24th November, 2025.

Earlier this week the present Chief Justice of India Shri B R Gavai proposed the name of Justice Surya Kant as the next Chief Justice of India.

Justice Surya Kant has been involved in several landmark judgments covering issues of constitutional law, gender justice, freedom of speech, and accountability.

NALSA( National Legal Services Authority) provides a free legal aid program for convicts within prisons through Prison Legal Aid Clinics (PLACs) set up in jails, as mandated by the Legal Services Authorities Act, 1987. These clinics are staffed by panel lawyers who provide services like legal advice, drafting applications, and informing inmates about their cases’ status.

In the present case , the Court was unsatisfied by the explanations regarding the delay and directed further explanation by jail authorities through the counsel for petitioner.
The affidavit from the Superintendent of the Central Jail , Kapurthala , Punjab specifically mentioned that the convict “never approached for the filing of the special leave petition” and was “not willing to file the same” before the apex court. It clarified that the SLP was filed solely pursuant to the directions of the National Legal Services Authority (NALSA) to provide free legal aid to prisoners.
