๐Ÿšจ CAN POLICE KEEP YOU IN CUSTODY WITHOUT TELLING YOU WHY?

Imagine being arrested but not being properly informed of the grounds of arrest.

What does the Constitution say?

โš–๏ธ ARTICLE 22(1) gives an arrested person the right to:
โžก๏ธ Be informed of the grounds of arrest as soon as possible
โžก๏ธ Consult and be defended by a lawyer of their choice

โฑ๏ธ ARTICLE 22(2) further requires that an arrested person be produced before the nearest Magistrate within 24 hours, subject to the constitutional exception relating to travel time.

But hereโ€™s the important part:

โŒ Failure to communicate the grounds of arrest is not merely a technical irregularity.

The Supreme Court has held that compliance with Article 22(1) is mandatory. If the constitutional safeguard is violated, the arrest is vitiated and the court must order release.

The Court has also laid down safeguards concerning any subsequent request for custody after such release.

๐Ÿšจ HONEY TRAP + EXTORTION: WHAT DOES THE LAW SAY? โš–๏ธ

A recent Jabalpur case has brought the issue of honey-trapping, blackmail and extortion into the news.

According to police, a woman identified as Pooja Raidas was arrested after allegedly demanding money from a real-estate businessman while threatening to implicate him in a false criminal case. Police allege that she was caught accepting โ‚น2.5 lakh as part of a negotiated payment.

Can the police arrest you without giving you the grounds of arrest in writing?

The Supreme Court has answered this question in Jaskaran Jeet Singh Deol v. State of Punjab (2026).

๐Ÿ”ด Key Point:
Grounds of arrest must be communicated in writing, in a language understood by the accused, and at the earliest.

โš–๏ธ The Court reiterated the constitutional protection under Article 22(1) and clarified that an illegal arrest does not give permanent immunity from re-arrest. Any re-arrest must strictly follow the procedure laid down by law and the Court.

๐Ÿ‡ฎ๐Ÿ‡ณโš–๏ธ CAN YOU BE FORCED TO SING VANDE MATARAM?

Can the State criminally punish someone who respectfully refuses to sing a National Song because of a genuine religious or conscientious objection?

The Supreme Court is currently examining this question in the context of the 2026 amendment to the Prevention of Insults to National Honour Act, 1971. During the September 22 hearing, the Court referred to the principle laid down in Bijoe Emmanuel v. State of Kerala (1986) and indicated that a conscientious objector should not face criminal consequences merely for refusing to sing.
