A Will can fail in court—even when it reflects the testator’s wishes!
In 2009, Murugaiah Pillai passed away, leaving behind 26 properties. He had executed a Will in 2005, but a critical error in its attestation proved fatal.
One of the witnesses testified that Murugaiah had signed the Will before visiting the witness’s house to obtain his signature. Neither attesting witness testified to witnessing Murugaiah sign the Will.
The Madras High Court found that the legal requirements for proving the Will had not been satisfied.
The lesson? Writing a Will is not enough. It must also be properly executed and attested.
✅ Ensure compliance with legal requirements.
✅ Choose witnesses carefully.
✅ Seek professional guidance.
Your legacy deserves more than a document. It deserves a legally valid Will.
Remember: A Will is not merely about who inherits your wealth. It is about ensuring that your wishes are legally upheld.
Have you reviewed whether your Will has been executed correctly?
