🚨 BIG US VISA UPDATE: Lawsuit Filed Against DHS Over New F-1 Rules! 🇺🇸✈️
A coalition of US education groups and unions has officially sued the Department of Homeland Security (DHS) to block the upcoming rule ending “Duration of Status” (D/S) for F-1 and J-1 visa holders.
Here is what you need to know:
⚖️ The Lawsuit: Filed on August 18, 2026, asking the court to stop the rule before its scheduled implementation date on September 15, 2026.
⏱️ The 4-Year Cap: Under the proposed rule, international students would no longer automatically stay for the entire duration of their studies. Instead, stay periods are capped at a maximum of 4 years, requiring an Extension of Stay (EOS) for longer programs.
⏳ Grace Period Cut: The grace period to exit or change status after finishing studies/OPT would drop from 60 days to 30 days.
💼 What it means for current students: Those already in the US under D/S remain protected until their I-20 end date or OPT completion (capped up to November 14, 2030), but future travel and extensions could trigger the new rules.
