The increase in demand and use for biofuels, a renewable energy that is a "clean" alternative to fossil fuel, have resulted in concerns about their impacts on sustainability and climate change. The European Union (EU) revised its Renewable Energy Directive (RED) to integrate sustainability and indirect land use change (ILUC) for biofuels. However, the EU Commission classified palm oil as the only biofuel feedstock crop with a high ILUC-risk, hence the EU Members may not attain their targets of renewables transport and it will have to phased out by 2030. Although palm oil is an effective source material to produce biofuels, it is linked to widespread deforestation and loss of biodiversity. The import of palm oil in the EU can have a significant impact on trade. This article analyses whether the ILUC policy as an environmental process and production method (PPM) measure with extraterritorial reach can amount to a breach of WTO rules of non-discrimination and/or justified under the General Agreement of Tariff and Trade (GATT).

[25 July 2019] ASEAN International Conference: Towards Increased Trade, Investment and Competition Policy and Law in the Southeast Asia Region
In cooperation with Chiang Mai University Faculty of Law, Universitas Pelita Harapan School of Law hosted an international conference on ASEAN, discussing about imperative issues on improving trade and investment as well as creating fair competition among ASEAN member countries. The main goal of this conference was to share ideas regarding the ASEAN vision toward ‘a higly integrated and cohesive economy’ ASEAN Members are committed to continue reducing or eliminating border and behind-the-border regulatory trade barriers to achieve competitive, efficient, and seamless movement of goods in the region.
Dr. Michelle Limenta, UPH CITI Director, presented her analysis on the trade facilitation within the ASEAN member states including a trade portal that publishes all laws, regulations and procedures affecting trade, and serves as repositories of information including non-tariff measures. This is crafted on the basis that improving transparency and access to information between member countries will allow business operators to facilitate import and export activities much easier, entailing lower prices for consumers in the end of the day.
Ms. Jerry Shalmont, UPH CITI Chief Operating Officer, served as the moderator that chaired the session discussing the ASEAN cooperation and integration. During this part of discussion, she assisted in chairing the 5 speakers presenting various topics that were taken into account of creating such mechanism that would best work and be implemented by ASEAN, including the role of the boards in the framework of the Indonesian capital market, the regional cooperation on ASEAN's competition law, the legal protection of migrant workers, trade facilitation to increase the transparency between ASEAN member states and also the TTEG (Tripartite Technical Expert Group) cooperation between Indonesia, Singapore and Malaysia on Safety of Navigation and Marine Environment Protection.
