Arguments for strong intellectual property protection proceed on the assumption that freedom from free riders is necessary to generate the monetary incentives needed to encourage intellectual production. In recent years, it has become clear that this assumption is not always true. Many creative industries are flourishing without intellectual property protection. Examples include fashion, comedy, magic, and software (consider, Linux, Apache, Firefox). Users also generate a vast array of innovations in sectors as diverse as extreme sports and scientific research. Now that non-monetary incentives to innovate have been recognized, it is time to think about how the rules of copyright and patent law ought to change to accommodate what might be called IP without IP (Intellectual Production without Intellectual Property).

The discussion that will follow will engage with Professor Dreyfuss´ argument and will reflect on the right strategies in order to develop incentives for intellectual production and the promotion of the knowledge economy in Greece, beyond the conventional policies of protecting IP rights.
