❓Does anticompetitive conduct threaten decision-making in democratic societies? Should modern antitrust be more flexible in order to accommodate policies that are prima facie alien to the furtherance of consumer welfare? Is modern antitrust becoming more and more precautionary? Is the use of algorithms in digital markets changing procompetitive justifications and theories of harm in competition law? Are new tools needed for the application of Article 102 TFEU? Does “competition on the merits” retain the content that antitrust theorists and practitioners know for years, is this fortified, or, is it ultimately an empty shell? Which is the essence of monitoring and sanctioning anticompetitive conduct when public spending is involved? And in which ways the antitrust scenery changes due to private enforcement of competition rules?
