From school refusal and daily crisis... to a fully funded independent specialist school.

A few months ago, one of our clients came to us exhausted. Their child couldn't access mainstream school, their mental health was deteriorating, and the Local Authority was dragging its feet on naming an appropriate placement.

"Can a Local Authority actually be legally forced to fund an independent specialist school?"

Short answer: Yes. 📄

We just celebrated a major win for one of our clients. The Local Authority officially agreed to name and fully fund an independent specialist school placement in Section I of their child's EHCP.

Before coming to us, the family was told that an independent placement wasn't an option. But here is the legal truth many families aren't told:

1️⃣ Section F drives Section I: You cannot win an independent placement without a crystal-clear, highly specified Section F. If the provision required to keep your child safe is detailed enough, it narrows down which schools can actually deliver it.

2️⃣ "Overwhelming expenditure" arguments can be challenged: LAs often argue independent schools are too expensive. However, if no mainstream or maintained school can meet the provision in Section F, cost is no longer the deciding legal factor.

3️⃣ Don't settle for "unassigned" or blank placements: A final EHCP must name a specific school or type of placement. Leaving it vague leaves your child in legal limbo.

When a child’s needs cannot be met in a mainstream setting, hearing "there are no suitable local schools available" is every parent’s worst nightmare. 💔

Recently, we worked with a family whose child was completely un-placed and unable to attend school due to severe anxiety and unaddressed neurodivergent needs. The Local Authority initially refused to consider an independent specialist placement, leaving the family facing months of uncertainty.

Through strategic advocacy, rigorous evidence collection and precise legal drafting in Section I (Educational Placement), Laura and the team fought for the child's right to an appropriate environment.

The Result?
✨ The Local Authority officially named and fully funded the independent specialist school in Section I of the final EHCP.

What this means for parents:
💡 Section I must reflect the child's needs, not LA budget constraints: Local Authorities have a legal duty to name a school capable of delivering the provision outlined in Section F.

💡 Evidence is everything: Securing independent funding requires robust independent expert evidence showing why state-maintained settings cannot meet the pupil's needs.

We hear this from exhausted parents every single week. You spent months (or years) fighting to get an EHCP issued, only to find out that the support promised on paper isn't being delivered in the classroom.

Before you blame the school or assume nothing can be done, check Section F of your document.

If Section F was written using vague, wishy-washy language, the Local Authority hasn't actually legally committed to funding specific provision.

3 red-flag phrases to search for in your document today:

🚩 "Benefits from small group work" (Doesn't state group size, frequency, or subject!)

🚩 "Overtime to build independence" (No baseline, no timeline, no strategy!)

🚩 "Input from occupational therapy as required" (No specified hours or specialist input!)

Just a few hours ago, Laura came out of a Local Authority mediation meeting with fantastic news for one of our local families.

The Local Authority had initially issued a Refusal to Assess decision, telling the parents that their child's needs didn't meet the threshold for an EHCP needs assessment. The family was left feeling dismissed, exhausted and stuck.

Instead of accepting the "No," we audited the evidence, tightened up the paper trail, and represented the family at mediation this morning.

The Result?

✨ The Local Authority completely overturned their decision! An official EHC Needs Assessment is now underway, putting this young person on the direct path to getting the legally binding support they deserve.

Is your child’s EHCP actually legally enforceable, or is it full of "loophole language"? 🧐

Many parents assume that once an EHCP is finalised, the support is automatically guaranteed. But if Section F relies on vague wording, Local Authorities and schools are not legally locked into delivering it.

Here are 3 phrases hiding in your child's EHCP that make it nearly impossible to enforce:

❌ "Access to a quiet space when needed" ➔ Means they only get it if a room happens to be free and staff are available.

❌ "Support from a Teaching Assistant as appropriate" ➔ Gives zero guarantee of actual 1:1 hours.

❌ "Regular monitoring by the SENCO" ➔ Leaves "regular" open to interpretation.

If Section F isn't specified (exact hours, frequency, and staff qualifications) and quantified (how long and how often), it isn't legally binding!

When an EHCP isn't delivering the support your child needs, 9 times out of 10, the problem starts in Section F.

The law states that Section F (the special educational provision) must be quantified and specified. That means it should leave no room for doubt about what is being provided, who is delivering it, and how often.

If your child’s EHCP contains vague language, the Local Authority and school are not legally bound to deliver specific hours, leaving your child without their required support.

🚩 3 Vague Phrases to Cut Out of Section F Immediately:

1️⃣ "Opportunities for..." or "Access to..."

Why it fails: Giving a child "access to speech therapy" does not mean they are actually receiving it.

Legally enforceable alternative: "30 minutes of 1:1 direct Speech and Language Therapy per week, delivered by a qualified Therapist."

2️⃣ "As required" / "As appropriate" / "When necessary"

Why it fails: Who decides when it’s necessary? This leaves support entirely open to school staffing constraints or budget cuts.

Legally enforceable alternative: "Daily 1:1 support during all unstructured times (recess and lunch)."

3️⃣ "Regular contact with a specialist"

Why it fails: "Regular" could mean once a week, once a term, or once a year!

Legally enforceable alternative: "Fortnightly 45-minute sessions with a Specialist Advisory Teacher."
