What is humanitarian(protection)?
လူသားချင်းစာနာထောက်ပံ့ရေးဆိုင်ရာ ကာကွယ်စောင့်ရှောက်ခြင်းဆိုတာ အကျဥ်းချုပ်ပေါ့။
အလွယ်ဆုံးပြောရရင် လူ့ဂုဏ်သိက္ခာနဲ့ ရပိုင်ခွင့်တွေရဖို့ လုပ်ဆောင်ပေးတဲ့လုပ်ငန်းစဥ်ဟူသမျှကို ကာကွယ်စောင့်ရှောက်မှုလို့ခေါ်ပါတယ်။
ဒီနေရာမှာ protection ဆိုတဲ့ Term ကတော့ နည်းနည်းတော့ ကျယ်ပြန့်တယ်ပြောရမယ်၊ ဘာလို့ဆို သူက လူ့ဂုဏ်သိက္ခာနဲ့အခွင့်ရေးအလွဲသုံးစားမှုတွေ၊ သဘာဝဘေးအန္တရယ်တွေအပါဝင်ပေါ့ မဖြစ်ခင်ကာကွယ်တားဆီးဖို့လုပ်ငန်းစဥ်တွေလုပ်ဆောင်တာ၊ ဖြစ်ပြီးတဲ့အခါမှာလည်း သက်ဆိုင်ရာ ထိခိုက်သူတွေကို ချက်ချင်းအခု လိုအပ်တဲ့ humanitarian support တွေပေးတဲ့အပြင် ရေရှည်သူတို့ဘဝတည့်တံ့နိုင်ရေး ရည်ရွယ်ချက်နဲ့ support ပေးတဲ့ လုပ်ငန်းစဥ်းအားလုံးကို rights-based approach နဲ့လုပ်ဆောင်ချက်တွေလို့ အကျဥ်းအားဖြင့်ပြောနိုင်ပါတယ်။

International Humanitarian Protection အကြောင်းတစ်စေ့တစ်စောင်း။
အသိတချို့ ကျနော့်ကို UK ရဲ့ Asylum Seekers & Refugees ပတ်သတ်ပြီး မေးကြလို့ ကျနော်လည်း အခုလောလောလတ်လတ် Asylum Support သင်တန်းလေးပြီးချိန် အချိန်ရလို့ နည်းနည်းပြောပေးပါမယ်။
ပထမဦးဆုံးအနေနဲ့ပြောရရင် Right to Asylum Seeking ဆိုတာ European Convention of Human Rights (ECHR)'s Article 3 အရ သက်ဆိုင်ရာ eligible ဖြစ်တဲ့သူတွေကို International Humanitarian Protection ပေးတာဖြစ်ပါတယ်။
✅What is an asylum seeker?
ဒီ ECHR's Art 3 အရ ဘယ်သူတွေက eligible ဖြစ်လဲဆိုတော့ race, religion, nationality, political opinion, social group (s*x, gender and etc) ဒါတွေနဲ့ပတ်သတ်ပြီး proven well-founded fear of prosecution ကို အမှန်တကယ် ရင်ဆိုင်နေရပါတယ်ဆိုတာကိုပြသနိုင်ရင် Asylum Seeking ကို လုပ်ဆောင်လို့ရပါတယ်။
ဥပဒေအရတော့ Refugee Status ရဖို့ Make-up stories ဖန်တီးတာကိုတွေ့ရှိရင်ပဲဖြစ်ဖြစ် Application Reject လုပ်နိုင်သလို Approved လုပ်ပြီးရင်တော့ ပြန်လည် ပြင်ဆင်ခွင့်ရှိပါတယ်။ အခုရက်ပိုင်းထဲ BBC မှာ False Story တွေဖန်တီးပြီး Asylum Claim တင်တဲ့သူတွေရော Law Firm တွေရော ဖော်ထုတ်ခံနေရပါတယ် သတင်းမှာ ရှာဖတ်နိုင်ပါတယ်။
Asylum Seekers ဆိုတာကတော့ Claim လုပ်ပြီးပြီ Decision ကျဖို့စောင့်နေတဲ့သူတွေကို ခေါ်တာပါ။ သူတို့က သက်ဆိုင်ရာနိုင်ငံ Govt က စီမံပေးတဲ့နေရာတွေမှာပဲနေခွင့်ရှိပြီး Generally အားဖြင့် Decision မကျသရွေ့ အလုပ်လုပ်ခွင့်လည်းမရှိပါဘူး။
ဒီကြာလအတွင်း သတ်မှတ်တဲ့ amount တစ်ခုကို သက်ဆိုင်ရာ Destination Country အစိုးရထောက်ပံ့ပေးပါတယ်။ NGOs တွေ Charity Groups တွေလည်း သက်ဆိုင်ရာ Services တွေအမျိုးမျိုးပေးကြပါတယ်။

Refugee ကတော့ Application Approved ဖြစ်ပြီးသက်ဆိုင်ရာခိုလုံခွင့်တောင်းတဲ့နိုင်ငံတွေမှာ နေထိုင်ခွင့် အလုပ်လုပ်ခွင့်အစရှိသဖြင့် ရသွားတဲ့လူတွေပေါ့။ Approved ဖြစ်သွားတာနဲ့ အရင် အစိုးရကပေးနေတဲ့ အထောက်အပံ့တွေ နေရာထိုင်ခင်းတွေအကုန် Terminate ဖြစ်သွားမှာပါ။ ခြွင်းချက်အခြေအနေလေးတွေတော့ ရှိတာပေါ့။
