EU Drivers Hours - Split Rest
Daily Rest may be split into 2 parts the first part not less that 3 hours and the second part not less than 9 hours giving a minimum of 12 hours rest in 24 hours.

Interrupted Daily Rest
Interrupted rest is used to enable the driver the embark and disembark on a ferry or train and can only be used if a total of 11 hours rest is taken.
An 11-hour rest can be interrupted no more than twice and for no more than 1 hour in total. E.g. 1 hours’ rest on land, 30 minutes embarkation, 8 hours rest on a ferry, 30 minutes disembarkation and a further 2 hours rest on land; giving a total of 1 hours’ interruption and 11 hours rest.

Double Manning
Each driver must have 9 hours rest in a 30-hour period. The 2nd driver does not have to be on the vehicle for the first hour of the journey but must then remain on the vehicle for the rest of the operation.

Remember that rest may only be taken on a vehicle that is stationary and has a bunk.

EU Drivers Hours - Weekly Rest
After no more than 6 x 24-hour periods a driver must take a weekly rest (for buses on non-regular international work this period may be extended to 12 x 24-hour periods).
A weekly rest is a daily rest extended into a weekly rest of not less than 45 hours, this period may be reduced to not less that 24 hours once in 2 consecutive weeks. If this exemption is used any reduction must be made up as a whole by the end of the 3rd week after the reduction and added to another rest period of at least 9 hours.

EU Driver Hours - Daily Rest
A rest is a period during which a driver can freely dispose of their time, which means that the driver must be able to leave the vehicle if they want to.
Daily rest must be taken within a 24-hour period.
The basic rule is that the driver must have 11 hours rest within 24 hours, this may be reduced to 9 hours 3 times in a fixed week i.e. 00.00 hours Monday to 24.00 hours Sunday.
Drivers Hours regulations apply to drivers of vehicles over 3.5t permissible maximum weight Including any trailer or vehicles carrying 9 or more passengers.
The penalties for failing to comply apply not only to the driver but can also apply to the Transport Manager and the Operator, they can include fines of up to £5000 per offence depending on the type of offence and prison for more serious or repeated offences.

EU Drivers Continuous Driving and Breaks
A break is a period for rest or recuperation of the driver and during that time the driver is not allowed to carry out any other work such as; cleaning mirrors & windows, doing paperwork, taking part in work related phone calls or supervising loading or unloading.
A driver must take a 45 minute break after no more than 4.5 hours driving, this break may be taken in two parts, the first part not less than 15 minutes and the second part not less than 30 minutes.
Irrespective of the amount of driving done up to 4.5 hours, when the driver has taken a total of at least 45 minutes break the driving period begins again.

EU Drivers Hours - Daily Driving
Driving between 2 consecutive rests, daily or weekly, must not exceed 9 hours or 10 hours on 2 days in a fixed week.
Weekly Driving
Must not exceed 56 hours in a fixed week.
Fortnightly Driving
In 2 consecutive weeks maximum driving must not exceed 90 hours, which means that if a driver drivers for 56 hours in one week they must not have exceed 34 hours in the previous week and must not exceed 34 hours in the following week.

Dangerous Goods Driver Training
An ADR card is required for carrying dangerous goods in packages above certain thresholds and in fixed or demountable tanks over 1000 litres.
The ADR Card must be produced to the Police and Department of Transport examiners (DVSA); it can also be required by the consignor of goods before the vehicle is loaded.
The card must always be carried when dangerous goods are being transported.
Apart from drivers, other people involved in the transport of dangerous goods by road, e.g. Traffic Staff, Loaders etc. also must be trained to a level appropriate to their responsibilities.
An ADR course is an intense course lasting for 3 to 5 days’ dependant on whether the course is an initial or refresher course and the modules selected.
The ADR Vocational Card is valid for 5 years and renewed by a refresher course in the 4th year.

EU Drivers Hours
EU Regulation 561/2006 applies as a rule to vehicles over 3.5 tonnes permissible maximum weight or buses adapted to carry 9 or more passengers and used commercially.
Vehicles that are exempt from EU Regulations must as a rule comply with British Domestic Regulations.
Common Exemptions
• vehicles undergoing road tests for technical
development, repair or maintenance purposes, and new or rebuilt vehicles which have not yet been put into service
Bus Exemptions
• vehicles with between 10 to 17 seats used exclusively for non-commercial passengers, e.g. minibuses used by voluntary and community groups.
HGV Exemptions
• breakdown vehicles - specialised breakdown vehicles working within a 100km of their base
• non-commercial vehicles under 7.5 tonnes - for example a person moving house or goods carried by a non-profit making group or registered charity
• vehicles or combinations of vehicles with a maximum permissible weight of 7.5 tonnes or less that are used for carrying work equipment for the driver.

Drivers Hours Emergencies
In an emergency drivers can exceed the drivers hours regulations by as much as is necessary to reach a place of safety for their vehicle and load. Drivers should then produce a printout for the period and write on the back details of the contravention, they should give a copy to the employer and keep a copy for themselves for at least 28 calendar days.
