Who Will the New Rules Apply To?

The rules will apply to:
• Anyone not already granted ILR when the new system starts.
• Most work, family, study, and protection categories.

They do not apply to:
• People already holding ILR
• EU Settlement Scheme (EUSS) settled status
• Windrush cases

What Is Changing?

The UK is introducing a new Earned Settlement System.
Settlement (Indefinite Leave to Remain – ILR) will no longer be automatic after 5 years.

Most migrants will now need 10 years before they can apply. Some may need 15–20 years, depending on their immigration route and personal circumstances.

Passengers whose immigration permission is still valid but whose BRP/EUSS BRC expires on or after 31 December can use until 31st March, 2025
