This decision by the IOPC is very disappointing. We strongly disagree and believe that Officer K should face a gross misconduct hearing.

We believe that the evidence at the inquest, including his behaviour after Sean’s shooting, undermines Officer K’s version of events, including his account that he honestly believed Sean had a gun. We consider he should have faced a gross misconduct hearing regarding his use of force, which would necessarily consider the truth of the accounts he has given since Sean’s death.

It has been 7 years since Sean was killed and our faith in the IOPC has continuously been eroded. The time they have taken to complete their initial investigation was totally unacceptable. We also believe the investigation was flawed from the start; from allowing Officer K to see his body worn video before giving a full statement (relying on post-deployment procedures which exist, a fact which is incomprehensible to us) to poorly selected experts who gave opinions on matters they were not qualified. We believe a good quality timely investigation would have shown that Officer K did not honestly believe Sean was a threat and that his actions were not only wrong but unlawful. - ❤️

The IOPC has confirmed the police officer who killed Sean Fitzgerald will not face gross misconduct proceedings

7 years …. It’s hard to even put into words the feelings today brings … 7 years of grief.. 7 years without you …

7 years on and this year was soul destroying going through your inquest side by side with your family and friends for 6 grueling weeks, seeing all they did to you and the lies they told, the corruption and no accountability for taking your life for nothing.

To watch those clips over and over again is something of nightmares but the strength your family and friends shown each and everyday for you, the fight that continues in your honor I no you would be proud of each and everyone of them

I still will never understand how a jury can see all the evidence and facts before them and come back with a lawful killing verdict just because a officer makes fabricated lies

The world knows the truth you never had a gun, you was never a threat and you never deserved anything that happened to you
The truth will always come out and one day we will have justice.

Each and everyday we think of you and miss your big smile and amazing character

Officers at the front of the property DID NOT yell before breaking down the doors, it has been revealed in a prevention of future deaths report (July 16). Jurors found that officers should have shouted at the front and rear of the property before they began entering, and when the curtain was seen moving.

During the long six week inquest into Sean’s death a lot of information was revealed about the actions that where taken that night by police

Two armed officers situated themselves at the rear of the house, both stood in dark clothing, no torches on, never shouted armed police or made it known at all that they where stood in the dark awaiting for someone to appear at the back of the house as a chainsaw and 10 other officers where at the front of the property trying to gain entry.

A Armed police officer known as officer k fired the lethal shot that killed Sean in less than a second of him opening the back door, it was then revealed that after Sean was shot and had fell to the ground the armed officers decided he was still a threat and handcuffed his hands across his front not only this but they then decided to drag his body into the alley way that was situated at the side of the house.
Inhumane and disgusting way to treat any human let alone someone they have just shot and would have been in pain.

Officer K made statements that he saw a gun draw back the curtain at the kitchen window to which then he claimed to see Sean holding a gun and claimed Sean took aim at officer k and the other officer at the rear of the house as he opened the door.
That was a LIE as bodycam footage shows Sean opening the door, no gun in his hand and no gun was ever found at the property.

Officer k also claimes to have shouted “gun” to inform his other officer of a threat.. when infact the body cam footage shows that “gun” was not shouted at all so that was a LIE.

Experts and specialists during inquest have made detailed reports most importantly claimed that in the time frame of Sean Fitzgerald opening the door officer k would not have been able to process so much detail that he claims in his statement to have seen in such a small amount of time
So that also was a LIE.

It is shown on the body cam footage shared that Sean had nothing in his left hand, in his right hand you can see the white door handle as he’s opening the door (this particular door opens outwards as you can see on the footage)
In the back of his right hand is a small black Nokia phone to which he threw on the floor.

Just to put it into context the part that’s shown on that bbc video of the bodycam footage and it’s stopped, at that moment Sean was hit by the bullet and fell to the ground at no point did he take more than one step or try to run.
I no this information is very upsetting for anyone to read but I feel the public need to no more about what happened and how it happened to see how Sean was killed and how UNLAWFUL his murder was.

Officer K also said while on the stand that he had done many operations the same or similar to this .. other operations where the suspect had a gun but he did not shoot.. so why when there was no threat or gun was a lethal shot fired.

I am just stating facts of what happened and what statements had been made by officer K during the inquest so it’s public knowledge.

For a jury to see all this in detail week after week day in day out and come to the conclusion of a lawful killing is unbelievable
The facts and video evidence show exactly what happened not a fabricated statement and lies made by officer k.

So by concluding this inquest as lawful killing what is the outcome of the safety of the general public.. any armed officer can shoot.. murder and lie no matter the evidence, bodycam footage, expert opinions and proven failures in the whole operation .. they have a license to kill and we as the general public need to stand up about this before someone else is murdered just like Sean.

SEAN FITZGERALD JURY IDENTIFIES FAILURES IN POLICE OPERATION

“We respect the jury’s decision but do not agree that Sean’s killing was lawful. After hearing all the evidence over the last 6 weeks we are very disappointed with the decision of lawful killing. We strongly believe the evidence indicates it should have been ruled unlawful killing. It has been incredibly hard and upsetting to hear of Sean’s last moments and listen to the accounts of the officers involved, especially Officer K. We completely disagree with his evidence and do not believe he genuinely believed Sean was a threat. We welcome the jury’s critical conclusion that there were serious errors in the planning, preparation and implementation of the police operation that cost Sean his life. Sean was not a threat, and it is hard to accept that Officer K’s mistake that cost Sean his life can be justified.”
