事由：關於社工局關所理據的嚴正反駁聲明

親愛的家長及各界好友：

韓衛局長於20/06/2020履新至今六年間，持續對本會採取打壓措施，並對托兒所的日常運作造成干擾。自上屆政府任期內，韓衛局長已經涉嫌蓄意製造事端抹黑本會，甚至一度暫停部分資助。其違規行為，本會得當時社文司司長確認違法以予撤銷，本會方得以恢復清譽。在此，特別鳴謝廣大家長及社會各界人士一如既往的支持與信賴。

韓衛局長於新政府履新初期（03/2025）啟動第一次關所程序，本會獲得包括上訴共兩次保全程序的裁決。而於09/2025韓衛局長再啟動第二次關所程序，本會雖於該程序中獲准保全措施，惟韓衛局長提起上訴後，法庭裁定撤銷是次保全程序。期間，本會發現社工局就托兒所編製之評估報告內容與事實不符。關於人員的誣控事宜，本會於嚴正聲明（5）已作反駁，但在昨天（11/05）社工局通過傳媒發出消息，把關所依據誣指為「不符合其監察要求」，並利用職權於以傳播，有關指控完全與不符事實，而且又持續加劇損害本會及托兒所的名譽。本會特此嚴正駁斥，希望韓衛局長立刻拿出證據，包括「他不懷疑的四名人員名單」。本會保留一切依法追究之權利，具體回應如下：

*Zonta Club of Macau still believes that cooperation between two parties should first always be based on moral commitment; unfortunately, Director Han Wei's conduct over the years makes it difficult for us to regain confidence.
*CCAC is actively investigating into the Social Welfare Bureau and its Director;

Dear Parents and Friends:

Since taking office on 20/06/2020, Director Han Wei has consistently taken suppressive measures against Zonta Club of Macau (ZM) and interfered with the daily operations of our nursery. During the previous government's term, Director Han Wei was suspected of deliberately creating trouble to smear ZM, and even temporarily suspended some funding. His illegal administrative actions were repeatedly confirmed as unlawful by the then Secretary for Social Affairs and Culture, leading to their revocation, thus restoring our reputation. Thus, we hereby would like to express our sincere gratitude to all the parents and members of the community for their continued support and trust.

Director Han Wei initiated the first closure proceedings at the beginning of the new government's term (03/2025), and ZM obtained rulings in two preservation proceedings, including appeal. On September 2025, Director Han Wei initiated a second closure procedure. Although ZM was granted preservation measures in this procedure, the court ruled to revoke the preservation procedure after Director Han Wei appealed. During this period, discovered that the assessment report prepared by the Social Welfare Bureau for the childcare center was inconsistent with the facts. Regarding personnel matters, ZM has already explained in our solemn statement (5), but the rebuttal issued by the Social Welfare Bureau through the media yesterday (11 May) is seriously inconsistent with the facts and continues to further damage the reputation of ZM and the childcare center. The Social Welfare Bureau now claimed that the reasons for closing the nursery were based that "not meeting their supervisory requirements" and abused its power to spread such information. Zonta Club of Macau hereby demands Director Han Wei to present proof immediately (including the 4 staff list Director Han carries no doubt). ZM solemnly refutes this and reserves all rights to pursue legal action. The specific response to IASM’s ungrounded announcement is as follows:

TDM Portuguese Late Night News on 13/05/2025: 廉政公署（CCAC）表示，將在有關社會工作局（IAS）與澳門崇德社 - 「崇專托兒所」之間糾紛的調查結束後，會向社會公布調查結果。 與此同時，該托兒所在最新發表的一份聲明中，再次強調其並未涉及任何違法行為，並重申要求政府對社工局局長韓衛的行為追究責任。聲明進一步指出，社工局此前透過媒體發布的澄清內容缺乏事實根據。

這則昨天葡文台新聞特別指出：1）崇德社要求政府嚴格調查韓衛局長；2）崇德社反駁社工局在上訴中提交法庭的文件中，有關對托𠒇所的評估報告內容不符事實，現正向終審法院上訴要求統一司法見解，及亷政公署亦在調查中；3）待亷署報告釐清事實後，將撤回所有訴訟；4）韓衞局長去年7月續期，只一年；(當年政府公佈：由20/06/2025起續期一年）

Yesterday's Portuguese TDM news specifically pointed out: 1) ZM demanded that the government conduct a thorough investigation into Director Han Wei; 2) ZM refuted the Social Welfare Bureau's assessment report on SMART Nursery submitted to the court, stating that the content was inconsistent with the facts; and is now appealing to the Court of Final Appeal for a unifying judicial interpretation of the Court’s ruling and CCAC is investigating; 3) All lawsuits will be withdrawn after the ICAC report clarifies the facts; 4) Director Han Wei's term was renewed last July for only one year. 澳門崇專托兒所（Smart Nursery，隸屬於澳門崇德社 Zonta Club Macau）表示，正遭受社會工作局局長的針對與打壓，並要求政府介入處理事件。

此番表態，是因為韓衛（Hon Wai）第二次嘗試關閉該托兒所，並引用一份報告，指托兒所存在違規情況。

崇專托兒所否認曾違反任何規定，並表示一旦廉政公署（CCAC）完成對事件的調查，將會撤回目前正在進行的司法訴訟。

社會工作局則回覆澳廣視（TDM）表示，當局確實已第二次提出終止與澳門崇德社 Smart Nursery 的合作，並強調整個程序均依法進行。

The following is a report from TDM:

Smart Nursery, operated by Zonta Club Macau, stated that it is being targeted and unfairly pressured by the President of the Social Welfare Bureau and is requesting government intervention.

This statement came after Hon Wai attempted to close the nursery for a second time, based on a report alleging irregularities within the institution.

The nursery denied violating any regulations and stated that it would withdraw the ongoing legal actions once the Commission Against Corruption (CCAC) completes its investigation into the matter.

In response to TDM, the Social Welfare Bureau confirmed that it has proposed, for the second time, the termination of its cooperation with Smart Nursery of Zonta Club Macau, and emphasized that the entire process is being carried out in accordance with the law.

韓衛局長於19/09/2025致函本會，以「不予續約」為由，再次啟動終止合作之程序。本次決定所依據之合作協議簽署於2019年8月22日，惟該協議實已失效，不再具法律效力。根據雙方於26/12/2024簽訂之新協議第18條規定，舊協議已告終止。韓衛局長在未具有效依據之情況下單方面作出不予續約之決定，程序上顯有違誤。

經查，韓衛局長在本次行政程序中，並未遵守《行政程序法典》之相關規範，包括未依該法典第113條規定正式開立卷宗，亦違反行政行為之適度原則與善意原則。本會據此已正式行文其監管機關，要求依據《行政程序法典》第123條及第124條規定，宣告該決定為無效並予以撤銷。惟未獲任何回覆。

有鑑於此，本會依法向法院申請保全程序，並於5/12/2025獲法院批准，裁定中止相關行政行為之效力。然而，韓衛局長對此提出上訴。本會亦發現社工局一份關於本托兒所之評估報告，該報告內容多處與事實不符，不僅進一步損及本會及托兒所之名譽。而在社工局的網站上亦發現有關訴訟的消息，本會接獲多位家長表達憂慮，特此作出以下嚴正聲明：

On 19/09/2025, Director Han Wei issued a formal written notice to the Zonta Club of Macau (“ZM”), invoking “non-renewal” as the stated ground and thereby once again initiating action aimed at the termination of the childcare center’s operations. In the present instance, Director Han Wei purported to rely upon a cooperation agreement executed on 22/08/2019, which had long expired and no longer possessed any legal force or effect. Pursuant to Article 18 of the new agreement signed on 26/12/2024, the former agreement had been expressly rendered invalid. Notwithstanding the foregoing, Director Han Wei unilaterally resolved not to renew the arrangement and commenced the present administrative procedure on the basis of the aforesaid agreement, which was devoid of legal validity.

In the course of the administrative procedure, it was ascertained that Director Han Wei failed to comply with several mandatory provisions of the Code of Administrative Procedure, including, inter alia, the requirement under Article 113 to formally open and register the administrative file. Furthermore, the contested administrative act contravened fundamental principles governing administrative conduct, namely the principle of proportionality and the principle of good faith.

Accordingly, ZM formally petitioned the competent supervisory authority, requesting, pursuant to Articles 123 and 124 of the Code of Administrative Procedure, that the decision be declared null and void and revoked. No response was received.

In light of the absence of any administrative remedy, ZM was compelled to apply to the Court for interim relief by way of preservation proceedings. On 05/12/2025, the Court granted the interim measures sought by ZM and ordered the suspension of the effectiveness of the impugned administrative act pending further adjudication.

Subsequently, Director Han Wei proceeded to lodge an appeal and submitted to the Court an evaluation report concerning the childcare center. As the contents of the said report are inconsistent with the factual circumstances, they have further aggravated the reputational harm suffered by ZM and the childcare center.

As ZM has, as of today, been receiving increasing inquiriZonta Club of Macau 澳門崇德社cern from parents reading new information about the court case from the bureau’s website, it is therefore necessary to issue a solemn and formal statement.
