No one disciplines the Hegemon
THE REAL WORLD: LAW ALONE DOES NOT EXPLAIN WHAT HAPPENED
Let us be honest: international politics is not governed primarily by international law. It is governed by power, diplomacy, and strategic calculation. Law matters but it is rarely decisive when great powers act.
So while the reported U.S. seizure of Nicolás Maduro clearly raises serious legal problems, stopping the analysis there would be incomplete. The following questions will permit us to better grasp what transpired.
IS THIS UNPRECEDENTED IN U.S. HISTORY? NO.
The United States has a long record of unilateral coercive actions against foreign leaders:
Manuel Noriega (Panama, 1989) – seized and tried in the U.S.
Osama bin Laden (Pakistan, 2011) – operation without host-state consent.
Qassem Soleimani (Iraq, 2020) – targeted killing of a senior state official.
Extraordinary renditions after 9/11 – bypassing extradition law entirely.
In each case:
Legal justification was contested
Diplomatic fallout was managed
Strategic objectives were prioritized
The pattern is consistent: the U.S. acts first, absorbs criticism later.
WHY ARE CONDEMNATIONS SO MUTED?
If this act had been carried out by Russia or China, the language would be explosive.
When the actor is the U.S., condemnation becomes carefully restrained.
This is not coincidence.
(a) Power Asymmetry
Most states:
Depend on U.S. security, trade, or diplomacy
Are unwilling to escalate beyond statements
So condemnation is symbolic, not confrontational.
(b) Selective Outrage
International law is often enforced selectively.
The norm is not equality before the law—it is hierarchy masked as legality.
(c) Legitimacy Politics
Many states do not view Maduro as a legitimate leader.
That political judgment weakens their willingness to defend him even if the method used is unlawful.
