Vai trò của các chủ thể tư pháp trong việc định hình Tư pháp quốc tế tư

Một góc nhìn so sánh

Nhân dịp kỷ niệm 150 năm thành lập Tòa án Liên bang Thụy Sĩ, Viện Luật so sánh Thụy Sĩ (SICD) trân trọng thông báo về Hội nghị lần thứ 35 về Tư pháp quốc tế tư, được tổ chức vào ngày 19-20 tháng 11 năm 2025 tại Lausanne.

Hội nghị sẽ phân tích vai trò riêng biệt nhưng có mối liên hệ mật thiết với nhau của các chủ thể này trong việc định hình tư pháp quốc tế tư đương đại.

Chúng tôi trân trọng kính mời các học giả (cả các nhà nghiên cứu đã thành danh và các nhà nghiên cứu trẻ), các nhà thực hành pháp lý và các nhà hoạch định chính sách gửi bài tham luận về các vấn đề này.

Các chủ đề có thể bao gồm:

Vai trò của tòa án quốc gia và siêu quốc gia trong việc định hình tư pháp quốc tế tư

Vui lòng gửi bản tóm tắt (tối đa 500 từ) về bài tham luận đề xuất của bạn trước ngày 11 tháng 5 năm 2025 cho Bà Marie-Laure Lauria , với tiêu đề "ISDC 35th PIL Conference Submission". Bản tóm tắt có thể được nộp bằng tiếng Anh, tiếng Đức hoặc tiếng Pháp.

Tất cả các bài nộp sẽ trải qua quá trình bình duyệt kín kép và quyết định sẽ được thông báo vào ngày 3 tháng 6 năm 2025. Các bài tham luận được chấp nhận sẽ được xem xét để xuất bản trong một tuyển tập được biên tập hoặc một số đặc biệt của tạp chí.

Article : The Impact of Landmark Judicial Decisions on Cross-Border Legal Relations in Intellectual Property Law

This article examines the significant impact of landmark judicial decisions on shaping cross-border legal relations within intellectual property (IP) law. In an increasingly globalized and digitally interconnected world, IP disputes frequently transcend national borders, necessitating a robust framework of private international law to address complex issues of jurisdiction, choice of law, and enforcement. The article analyzes how key judicial pronouncements by national and supranational courts have shaped this framework, providing clarity and guidance for resolving international IP conflicts.

The analysis begins by exploring the evolving principles of jurisdiction in cross-border IP disputes. Landmark cases that have established or refined the "sufficient connection" or "minimum contacts" test are discussed, highlighting how courts determine whether they have the authority to adjudicate disputes involving foreign defendants or activities. Special attention is given to the challenges posed by online IP infringement and how judicial decisions have grappled with the "targeting" principle to establish jurisdiction over online activities directed at specific markets. The role of supranational courts, such as the Court of Justice of the European Union (CJEU), in harmonizing jurisdictional approaches within their respective regions is also considered. These judicial developments have significantly impacted the predictability and certainty for IP right holders, their ability to pursue infringers across borders, and the potential for forum shopping.

The article then developed into the complexities of choice of law in international IP disputes. It analyzes key judicial decisions that have influenced the determination of which country's law applies to substantive IP issues, such as infringement and validity. The judicial approaches to determining the law applicable to international IP licensing agreements are also discussed. These decisions play a crucial role in balancing respect for the territoriality of IP rights with the need for clear rules to govern international transactions.

Furthermore, the article addresses the critical issue of recognizing and enforcing foreign IP judgments. It examines landmark judicial decisions that have established the criteria for enforcing such judgments, including considerations of due process and public policy. The specific challenges of enforcing IP judgments across borders, such as differences in the scope of IP rights and available remedies, are highlighted. The influence of international agreements, such as the Hague Conventions, on the enforcement of IP judgments is also analyzed. These judicial pronouncements are essential for the effectiveness of cross-border IP litigation and serve as a deterrent against international infringement.

Finally, the article explores how judicial decisions are responding to emerging challenges in cross-border IP law, driven by technological advancements and globalization. These challenges include online infringement, the rise of global value chains, and the implications of new technologies such as artificial intelligence and blockchain. The article analyzes how courts are adapting traditional IP principles and developing new legal frameworks to address these novel issues with cross-border dimensions.

In conclusion, the article underscores the pivotal role of landmark judicial decisions in shaping the legal landscape for cross-border IP disputes. These decisions provide essential guidance on jurisdiction, choice of law, and enforcement, and they demonstrate the judiciary's crucial function in adapting IP law to the evolving challenges of a globalized and interconnected world.

Viện Luật So sánh tổ chức cuộc họp định kỳ vào thứ Sáu hàng tuần để thảo luận về các vấn đề quan trọng của Viện. Một trong những nội dung trọng tâm của các cuộc họp này là việc lên kế hoạch và chuẩn bị cho các hội thảo khoa học.

Tầm quan trọng
Hội thảo khoa học là một hoạt động quan trọng của Viện Luật So sánh, có vai trò quan trọng trong việc:
Chia sẻ và trao đổi kiến thức: Hội thảo là nơi để các nhà khoa học, luật sư, chuyên gia và những người quan tâm đến lĩnh vực pháp lý so sánh chia sẻ những kết quả nghiên cứu mới nhất, những ý tưởng sáng tạo và kinh nghiệm thực tiễn.
Nâng cao chất lượng nghiên cứu: Thông qua việc tham gia hội thảo, các nhà nghiên cứu có cơ hội nhận được những phản hồi, góp ý từ đồng nghiệp, từ đó nâng cao chất lượng nghiên cứu của mình.
Xây dựng mạng lưới quan hệ: Hội thảo là dịp để các nhà khoa học, luật sư và chuyên gia gặp gỡ, giao lưu, trao đổi và xây dựng mối quan hệ hợp tác trong nghiên cứu và công việc.
Góp phần vào sự phát triển của luật so sánh: Các hội thảo khoa học do Viện Luật So sánh tổ chức góp phần quan trọng vào việc thúc đẩy sự phát triển của lĩnh vực luật so sánh ở Việt Nam.
Nội dung thảo luận trong cuộc họp

Trong các cuộc họp thứ Sáu hàng tuần, Viện Luật So sánh thường tập trung thảo luận về các vấn đề sau liên quan đến kế hoạch hội thảo:

Xác định chủ đề của hội thảo: Chủ đề của hội thảo cần được lựa chọn dựa trên những vấn đề pháp lý so sánh đang được quan tâm, có tính thời sự và có ý nghĩa khoa học.
Lựa chọn thời gian và địa điểm: Thời gian và địa điểm tổ chức hội thảo cần được lựa chọn sao cho phù hợp với lịch trình của Viện và thuận tiện cho các đại biểu tham dự.
Xây dựng chương trình hội thảo: Chương trình hội thảo cần được thiết kế một cách khoa học, hợp lý, đảm bảo sự cân bằng giữa các phiên thảo luận toàn thể và các phiên thảo luận nhóm.
Mời diễn giả và đại biểu: Viện Luật So sánh sẽ mời các nhà khoa học, luật sư, chuyên gia có uy tín trong và ngoài nước tham gia trình bày và thảo luận tại hội thảo.
Chuẩn bị tài liệu và các công tác hậu cần: Viện Luật So sánh sẽ chuẩn bị tài liệu hội thảo, đảm bảo các công tác hậu cần như thuê địa điểm, in ấn, đón tiếp đại biểu... được thực hiện chu đáo.
Kết quả đạt được

Nhờ có các cuộc họp định kỳ thứ Sáu hàng tuần, Viện Luật So sánh đã tổ chức thành công nhiều hội thảo khoa học có chất lượng, thu hút sự quan tâm của đông đảo giới học thuật và những người làm trong lĩnh vực pháp lý. Các hội thảo này đã góp phần quan trọng vào việc nâng cao nhận thức về luật so sánh, thúc đẩy nghiên cứu khoa học và xây dựng mạng lưới quan hệ hợp tác trong lĩnh vực này.

Định hướng trong tương lai

Trong thời gian tới, Viện Luật So sánh sẽ tiếp tục duy trì và nâng cao chất lượng của các cuộc họp thứ Sáu hàng tuần, đồng thời tăng cường tổ chức các hội thảo khoa học có quy mô lớn, có sự tham gia của nhiều chuyên gia quốc tế, nhằm đưa lĩnh vực luật so sánh của Việt Nam ngày càng phát triển và hội nhập sâu rộng vào cộng đồng khoa học thế giới.
