At the trial, Gerald Stanley did not claim self defence, but said the gun just went off due to a "hang fire." Gerald Stanley claimed that the shooting of Colten Boushie was an accident using his "magic bullet" defence.
Against the testimony of an RCMP fi****ms expert that called the "magic bullet" defence impossible, the all-white Saskatchewan jury bought it and acquitted Gerald Stanley of all crimes before Saskatchewan Judge Popescul. The not guilty verdict was not appealed by Saskatchewan prosecutors even though many legal experts pointed to problems.
The Battleford RCMP was later the subject of an investigation by the Civilian Complaints Commission for the RCMP that was initiated by the chair of the commission. Now the Sask Party's Conservative MLA colleagues to the East are commenting on a very painful and damaging incident in Saskatchewan's culture.
Truly sad.
In Canada (and most of the world, except hillbilly states like Florida) it is illegal to use excessive force in self defence.
You also cannot use deadly force to stop a property crime, such as stealing something.
Trespassing is not a crime under the Criminal Code in Canada except if it is done at night. Provinces have made it a fine offence in some places.
The settler racists are going overboard in the comments again.
