🇩🇰 Denmark has recently been in the news for its law aimed at combating AI deepfakes. In addition to this groundbreaking initiative, I think some practices observed in Danish courthouses should also be shared and potentially adopted by other countries:
- The courtroom lacked traditional formality. If I hadn’t been informed that it was a criminal trial, I might have mistaken it for an ordinary business meeting, as no one was wearing robes, wigs, or ties;
- There was no crucifix displayed. The walls featured abstract paintings, and if I hadn’t paid close attention, I might have missed a faint balance scale in one of them;
- The furniture was simple and unadorned, prioritizing functionality and a homelike atmosphere over ostentatious design.
Note: As I don’t speak Danish, my observations from attending a hearing at Copenhagen’s Courthouse are limited to its dress code and courtroom settings. Nevertheless, it was thought-provoking.

I chose “Dark Waters” not only for its legal vocabulary and courtroom scene but also because it inspired me both as an attorney and as a human being.
As for its legal vocabulary, I would like to share the following:
- Gag order: a court order prohibiting those involved in a case from discussing it publicly.
How to use gag order in a sentence:
1) The judge imposed a gag order on all involved in the trial.
2) But the judge ruled that Stone repeatedly flouted (ignored) her gag order.
3) The judge amended the gag order to cover his and Mr. Bragg’s families.
4) But with the lifting of the gag order, Mr. McCraw said he had been freed to explain what had happened.
5) The parties in the case are under a gag order, unable to communicate with the press.

Dois Sistemas Jurídicos, mais uma semelhança!
Refiro-me neste post aos Sistemas Jurídicos do Civil Law (Brasil) e do Common Law (EUA). Esses dois sistemas jurídicos têm muito mais em comum do que se imagina. Um deles é a existência de dois juízes com funções diferentes.
Assim como no Brasil, nos EUA existe o Juiz de Paz e o Juiz de Direito. O primeiro pode ser traduzido como Justice of Peace (JP) ou “Lay Judge” e o segundo como “Judge” (J) ou “Justice” (J), a depender da instância.
Assim como no Brasil, nos EUA o Juiz de Paz e o Juiz de Direito possuem funções diferentes. O primeiro, a depender do Estado dos EUA, pode celebrar casamentos, julgar pequenas causas, infrações de trânsito, ou até mesmo contravenções. O segundo, tem a função de julgar casos e conflitos.

A Brazilian judge ordered the removal of Adele’s song due to a plagiarism claim!
Three years ago, I posted about this case. At that time, the plaintiff (Toninho Geraes) was, with no success, sending letters before action to the defendants (Adele, Greg Krustin, XL Recordings, and Sony do Brasil).
Back then, I mentioned some legal remedies available to the plaintiff if the defendants did not settle out of court. And the first remedy I listed was an injunction.
Some students asked me backstage how such a ruling could be enforceable in other countries. I remember telling them about a decision rendered elsewhere in a similar case. Some still doubted a Brazilian judge would come to the same conclusion since there was no precedent...
This goes to show the benefits of studying Comparative Law.
