Changes to the Immigration Rules of UK come into effect

As previously announced, a number of changes to the Immigration Rules are coming into effect today (1 October 2012).

New Rules now apply for extending your visa

If you are applying to extend your visa under the points-based system, all working and student routes, visiting routes, long residency routes and discharged HM Forces and UK ancestry routes, new rules will now apply.

If you have limited leave to enter or remain in the UK and wish to extend your visa, you must apply within 28 days of your current visa expiring. Your application for further leave will be refused if you have overstayed your visa by more than 28 days when you apply.

If you have no right to be in the country we expect you to leave voluntarily and we will enforce your return if you fail to do so. Where we need to enforce someone's return they may be subject to a ban on re-entering the UK.

Changes to Tier 1 (Exceptional talent) route
Minor changes to the Tier 1 Exceptional talent route come into effect today. These changes are intended to clarify the rules of this route and make it easier for suitably qualified applicants to apply.

The changes include:

An amendment to the definition of the purpose of the scheme, to explain that the "exceptional promise" aspect does not apply to the field of the arts.
Small amendments to the criteria used by The Royal Society, The Royal Academy of Engineering and The British Academy to assess applicants, following discussions with these designated competent bodies.
Widening the eligibility by allowing Tier 2 (General) migrants and sponsored researchers who are Tier 5 (Temporary worker) migrants to switch into the Exceptional Talent route while they are in the UK.
Changes to the unique reference number (URN) system.
Clarification of the evidence for extension applications.
New streamlined UK visa application process for students from Botswana and Malaysia
From today, Botswana and Malaysia have joined the list of low-risk countries, whose nationals applying for a Tier 4 student visa benefit from a streamlined UK visa application process.

Under the streamlined process eligible applicants will generally not be expected to provide documentary evidence of financial maintenance and education qualifications, making the application process simpler and easier. Applicants from Botswana and Malaysia will still need to meet the requirements and students must be able to provide the appropriate documents if requested. Further information on documentary requirements for low-risk nationals and who qualifies can be found on the Studying section of our website.

Changes to the Immigration Rules

A written ministerial statement has been laid in Parliament today outlining a number of changes to the Immigration Rules.

The changes amend the Immigration Rules further to the Supreme Court's judgment in the case of Alvi . They follow on from the earlier changes on 19 July 2012 in response to the same judgment, which required that requirements that were previously set out in Home Office guidance be incorporated into the Immigration Rules.

Some further amendments that are not related to the Supreme Court's judgment are also being made, including:

changes to the family and private life rules and the transitional provisions for dependants of points-based system migrants;
changes to Tier 1 (Exceptional talent) of the points-based system; and
changes to the list of low risk countries for the purpose of Tier 4 of the points-based system.
The rules changes will come into effect tomorrow (6 September 2012), except the changes to the list of low-risk countries for Tier 4 and the Tier 1 (Exceptional talent) route, which will come into force on 1 October.

New interviews for students

Following a successful pilot, Immigration Minister Damian Green has announced that a targeted interview system for students will be introduced this summer and will concentrate on high-risk applicants.

If you are a student, you may be interviewed and asked a number of questions about your immigration and education history, study and post-study plans, and financial circumstances. We expect to interview up to 14,000 students in the next 12 months. We will refuse visas if we are not satisfied that you are a genuine student.

Immigration Minister Damian Green said:

'With more interviews and greater powers to refuse bogus students we will w**d out abuse and protect the UK from those looking to play the system.

'Under the current system UK Border Agency officers are unable to refuse some applications even if they have serious concerns over the credibility of the student - we are toughening up the system to ensure genuine students benefit from our country's excellent education sector.

'Britain is open for business to the brightest and the best migrants but the message is clear - if you lie on your application form or try to hide your true motivation for coming to the UK then you will be found out and refused a visa.'

Today's announcement follows an interviewing pilot carried out by the agency last year to tackle concerns about the legitimacy of some applicants. More than 2,300 student visa applicants were interviewed in 13 overseas posts with the aim of testing how effective face-to-face interviews would be - in addition to existing strict application processes that consider fraud and other factors.

Under the pilot, around a fifth of the applicants were refused entry to the UK based on their interview. One of the main issues was the inability of interviewees to display the required level of English. Some were unable to answer basic questions in English without the aid of an interpreter - despite stating on their application forms that they had the necessary language qualifications to study at higher and further education standards in the UK.

New rules will come into force within weeks to cut abuse of the student visa route and ensure that only the brightest and the best students can stay and work in the UK, Immigration Minister Damian Green announced today.

Students can currently work in the UK for 2 years after their studies have finished, under the Tier 1 (Post-study work) route. But from 6 April, a more selective system will come into effect so only the most talented international graduates can apply to stay in the UK for work purposes.

Only those who graduate from a university, and have an offer of a skilled job at a salary of at least £20,000 (or more in some cases) from a reputable employer accredited by the UK Border Agency, will be able to continue living and working in the UK in order to benefit the British economy.
