If u donβt want to memorizeβ¦
A law student asked me this:
βAtty. do I really need to memorize provisions of the law in order to pass the bar?β
My Answer to him:
First, Iβll be honest, Iβm not a fan of pure memorization. I donβt have a photographic memory, and as a working law student, I didnβt have the luxury of spending endless hours memorizing provisions word for word. More importantly, I discovered that memorization alone doesnβt work for me. Itβs like filling your mind with data but not knowing when or how to use it.
Instead, I follow a three-step approach: understanding, retention, and application (URA).
1. Understanding.
Before anything else, I make sure I truly understand the concept behind the provision. Once you grasp why the law says what it says, it becomes much easier to remember. Law is logical, every rule has a reason.
2. Retention.
When you understand something deeply, it naturally stays with you longer. I reinforce this by revisiting the concepts through quick reviews or by discussing them with classmates.
3. Application.
Finally, I apply what Iβve learned, to past bar exam questions, case digests, and practical scenarios. This is where understanding turns into mastery. When you practice applying the law to facts, the provisions begin to βstickβ without forcing yourself to memorize every word.
So, to answer your question, no, you donβt need to memorize every provision verbatim to pass the Bar. What you need is to understand the law so well that even if you donβt recall the exact words, you can explain and apply the principle accurately and confidently. Thatβs what the Bar exam really tests, not really your memory, but your mastery.
Thatβs the method that helped me survive law school and the Bar. I hope it helps you find your own rhythm in studying the law.
