QUESTION 1 (2 marks)
Outline one reason why the County Court of Victoria may not be bound by a precedent set in the Supreme Court of Victoria.

"In order to gain full marks, students needed to provide an outline of a correct reason that the County Court may not have to follow a Supreme Court precedent. This question asked for one reason. Often responses provided more, but doing so was not required, nor could it earn any further marks."

Within the Study Design you need to be aware of three rights: 1. The right to be tried without delay. 2. The right to silence. 3. The right to a trial by jury.
If we consider Erin Patterson, she had these three rights whilst facing the charges in court.
(Hint: Take care when noting discussing state based indictable offence v Commonwealth indictable offence.)
