On 13 July 2022, a Truck Driver sustained serious injuries when he was struck by a forklift within a loading dock while he was conducting preparatory works for the loading of roof panels onto his truck for delivery.
HMR Supplies Pty Ltd pleaded guilty in the District Court to offences pursuant to sections 19(1)/32, 38, 39 and 43(2) of the Work Health and Safety Act and was fined a total of $165,000. Its Director was fined $45,000 for a breach of section 27/32 of the Act and its Operations Manager was fined $5,000 for a breach of sections 28(b)/32 of the Act and ordered to complete the Certificate IV in Work Health and Safety Course at TAFE NSW.
It was found that HMR Supplies Pty Ltd did not notify SafeWork NSW following the incident and at the time of the incident the Operations Manager who was operating the forklift did not hold the relevant High Risk Work License to operate a forklift.
HMR Supplies Pty Ltd, the Director & the Operations Manager have the right to appeal this sentence.
