An ever-moving feast, cryptocurrency has now been recognised as property in various common law jurisdictions. However, the issue has not yet arisen in substantive proceedings in Australia, as such, much of the reasoning and commentary as to the particular nature of cryptocurrency as property is open to question.
This seminar will examine that reasoning and demonstrate that longstanding High Court authority on 'property' should yield a clear answer in favour of the view that cryptocurrency is property.
